Hello, my name is Charlotte and I have just joined this community tonight. I have some significant mental health problems and have been feeling pretty bad of late. I wonder if anyone in the know can advise me, please? My husband is currently in ESA support group, it isn't a joint claim but he receives the couples rate. We both received our migration notices at the weekend. We are to create an account for each of us and then link it. So, I guess they (DWP) want to make us joint claimants. I am in receipt of Adult Disability Payment (Scotland) I receive the enhanced rate for day to day living, and the standard rate for my mobility, I don't claim for any other benefits the ESA is in my husband's name. I am terrified that once we start the claim that I will be assessed and then made to work. I know my husband's claim carries over, but, what will happen to me? My heart is pounding just typing this. Any advice would be most appreciated. Sorry it's such a long post. I'm just scared and feel a bit alone. X

    Unfortunately your suspicions are correct, your husband has automatic entitlement to LCWRA (the UC equivalent of ESA Support Group) but you will not.

    Upon claiming UC you'll need to report your health condition and submit a Fit Note.

    On day 29 you should be referred for a Work Capability Assessment. This involves being sent a UC50 form to fill out and return, then most people have a medical assessment.

    Please note if found to have LCWRA no extra money will be paid. This is because in a couples claim, the maximum number of LCWRA elements payable is one.

    You would still have no work commitments.

    I know you get ADP but this counts for nothing under the UC WCA process.
