Hi all

Just looking for some advice regarding my daughter who'll be 20 this September.

She has stayed in college so I've continued to receive the child element for her, I also receive the disabled child element as she has autism.

Her college course is due to end this summer. She'll then put in a claim for UC in her name.

Do UC require proof of when her college course ends?

Just thinking if to get this information ready from her college incase it's required.

To complicate matters, my daughter is currently off sick from college and has been for a few months due to her mental health plus she's waiting for surgery on her gallbladder so been in quite alot of pain.

Her GP has signed her off until may.

The surgery is possibly taking place in July. So the likelihood of her returning to sit her exams is slim.

Do I need to report my daughter's absence from college to UC?

Really confused as all new to me and having health issues myself (Crohn's flare) and struggling to keep on top of everything.

    Hi,

    There's no need to report her current temporary absence to UC. She will still be classed as 'in education' until the course finishes, unless she specifically leaves permanently before then.

    I'm not sure whether UC do ask for proof of the course end dates but I think it is a good idea to get that anyway if you can. You may find that the end dates are shown on an online portal if your daughter has access to anything like that.

    Called UC today and they've left me more confused than ever.

    I explained the whole situation to them and clearly stated I receive child element of UC for my daughter, they then opened my daughter up a universal credits account in her own name and booked her an appointment at the job centre for next Friday.

    They said her first payment will be in may (unsure if the amount)

    But surely my daughter can't claim universal credit in her name if she's still on my claim?

    Really confused 😕

    I'm confused by that as well, I can't understand why they've done that. You're right that she can't receive UC in her name at the same time as you're getting Child Element on your UC. So they would remove your child element and disabled child element when her claim starts as far as I understand.

    Generally it isn't possible to claim UC while still in full time education though. There are a few exceptions to that, and being disabled is one of them. However, they need to have proven Limited Capability for Work via a WCA assessment before starting the course, which I assume hasn't happened in this case.

    Perhaps there are some new or special rules that I'm not aware of though. I'm sorry I can't offer any better advice on this situation. Hopefully another member may have experience of the same thing.

    Thankyou all very much for your help.

    I'm really confused too.

    My daughter stayed on a extra year at college due to autism to re sit maths.

    However she's been struggling alot with her mental health plus physically with her gallbladder issues which she'll be having surgery for in August.(Hospital confirmed that yesterday)

    Due to her struggles she's not attended college for several months. And unlikely she'll go back this year.

    So maybe it's for the best she does claim universal credits in her own right.

    They say her first payment will be may 23rd... My universal credit payments are on the 19th of every month... Does that mean my last payment for my daughter will be 19th of may? Or will it stop now?

    Regarding lcwra, that is something my daughter will be applying for, do we explain all that at the job centre next week?

    Your daughter will need to provide a fit note from a GP in order to start the work capability process.

    She can provide that at the Job Centre visit. Or within 7 days afterwards. In order for LCWRA to be applied from the start of the claim. (Assuming she is awarded LCWRA after assessment.)

    If the fit note isn't supplied within 7 days, she will lose that month of LCWRA and the 3 months waiting period will start from the next assessment period instead.

    Regarding your payments, I think they will stop now. UC elements are always paid over a full assessment period. So with the change being made during the current period, I don't think you'll get another payment. (Your April 19th payment should have gone in yesterday due to weekends and bank holidays).

    That's great. Thanks for all your help. Unsure what to do for the best to be honest.

    Don't know if it's worth my daughter claiming on her own name now or just waiting until her college course ends. If we chose to do that could we close the claim and reopen it once her college course has ended?

    Now that her claim has been started, I don't think you can just close it at this point unfortunately. This is an unusual situation though.

    If it does get closed then there are two options. Within 6 months the old claim can be reopened in the journal. After 6 months the old claim is lost and a brand new claim has to be started from scratch.
