Accrued holiday taken as pay

Hey all,

I've been on new style ESA in the support group since December 2023 when my sick pay ended. My employer would like me to return to work if I improve enough to. I have long covid that has worsened after a dvt and lung clots. I'm trying a lot of treatments but I've not yet improved enough to try working again. Although I'm not being paid they've said I'm accuring holiday and asked if I wanted to take it as pay. I have no idea how that would work with ESA or how to figure it out so I've just let it be but they keep asking so I wanted to see what the advice is if anyone knows? I keep expecting them to let me go but they haven't said they will yet maybe soon I don't know.

    Ok, Im no specialist, but from reading your post im sure being on NS ESA allows you to have some permitted earnings (I believe you are able to earn £195.00 a week as long as you work under 16 hours) I do permitted work myself too….

    Now I know you mention holiday pay as opposed to actually going to work at the moment but it might be worth looking in too and also getting in touch with the New Style ESA department to enquire about "permitted work/earnings" and the holiday pay payment…

    I had a similar situation when I first claimed ESA (legacy benefit, not New Style). I recall that I rang DWP, explained I would be getting accrued holiday pay in one payment as my job had been terminated on ill health. DWP asked me to post them evidence of the termination and my payslips. My pay slips did show no payment made for 'work' and payment of 'holiday'. I didn't hear anything further about it from DWP and my ESA remained in place.
