Hi, I wonder if someone can help me.

In September 2023 I moved to a new place. Life was great before this. I earned really good money, had an amazing life. Mortgage rates went up to 6% and I thought due to this rip off amount by the banks it was time to move to a bigger property but the same mortgage rate. It was an hour an half away from my kids which pained me but I thought it wouldnt be an issue. Life was good my realtionship with them was great and still is.

Then life changed, my dad died (76), my career ended due to redundancies and just the sheer volume of people looking for work in my industry, salary expectations and age. Even reducing the salary significantly has resulted in no work for just under 2 years.

My dad always said to me, if I do nothing else, make sure my NI is contributed towards. So, as I was not working, I contacted the job centre. They put me on UC. I explained to them I wasn't there for the money, just my NI contribution. I am self-employed by nature, but they gave me UC £360 a month minus CSA.

Now I had savings, I had a good life. My mortgage is £2100+ a month, manageable when working, not when unemployed and no income. My savings went down a lot, I sold assets to survive, Im now £12k in mortgage arrears and £30k in debt with the bank. No income and my outgoings are still over £1200 a month and were more £3500 a month prior to this mess.

Now fast forward nearly 2 years and UC have asked me for 4 months bank statements and my ID. I have questioned what this is for and they are saying its to do with capital gains etc. Now we know they are going to try and do me for fraud. I know most if not all people on UC can't survive on £360 a month when a mortgage payment is £2100. How can you be a mortgage payer yet, when times are hard get no assistance whatsoever to help towards the mortgage. So my savings I had and money from assets sold, have gone towards my mortgage and credit card payments. To be fair, I never had one credit card in 20 years, now I have 6 and each has a payment up to £150…. I'm F*****.#

I have tried to sell my house no views or offers. I am trying to rent the house out but the bank have refused as I am in arrears.

What am I to do? Yes I had savings but that was only to pay debts. Society tells us to pay debts, UC have not helped with any housing costs, or any of my debt….. so whilst I had savings to survive and society has told us to save for a rainy day… Im now going to get done for fraud as I did not decalre my savings…. I didnt think I needed to as I didnt want £360 a month, I wanted my NI paid…. they decided to give me £360. I didnt once ask for it, and I said all along to my advisor I don't want the money, I want my NI paid and contributed.

So now I am in a dilemma. Do I send the bank statements knowing they will scrutinise every payment and say, " Where is this money coming from to pay your debts (savings account transactions) or do I just walk away ignore it and not send anthting over.

I have adhered to all of their polices, I have attended all of the UC meetings and even for a year gone to their restart programme. they have not done anything to find me work I have self paid for courses as they wont fund anything, they offer minimum wage cleaning jobs or security guard.

For context I paid in 2 years prior £132k in tax in 2 years… so feel I am in credit with them although I know this does not work this way. I had to sell assets from my dads death and my car just to keep head afloat and now it looks like they want to do me for fraud….. any help or advice.

    They are reviewing millions of claims as standard practice.

    Capital over £6000 reduces UC award by £4.35 for every £250, or part thereof over that amount. Capital over £16k means no eligibility for UC.

    The home you live in is not counted as capital.

    Payment of debt is generally allowed under UC, sudden overpayment of mortgage might still be classed as deprevation of capital etc.

    I'd recommend speaking to a trained benefits advisor

    Hey there @WorzilGummage and a warm welcome to the community.

    As Kimi has said, the DWP is calling thousands of people in for random reviews, so it's nothing you've done wrong, so please don't worry there. Though if you had savings over £5,999 previously that were undeclared whilst claiming UC, then speaking to someone from Citizens Advise may be the best route here, as we're not best equipped to deal with the more complex benefits queries.

    I had savings as I knew my mortgage and credit cards would need to be paid. The DWP/UC would not pay mortgage payments (yet if I were on benefits full time and never had a mortgage, my rent would have been paid towards). I specifically came to get my NI contributed to. they put me on UC, I follwed their rules of updating job applications and going on to the Reed programme. I never missed an appointment and it cost me money via petrol to go in and see them at the job centre… So yes, I had savings, but what does this country want? No savings (even though I am sure I was taught and told to have savings for a rainy day), get into debt, default on mortgage payments (which I have now 5 months), miss credit card payments (which I am about to enter month 1).

    It makes no sense to me. Not only have I lost my career, but I will soon be home and in serious credit card debt, and I will get told I have committed fraud as well to boot.

    However, I am sure an assylum seeker coming in on a boat is not asked for 4 months' bank statements when they arrive.

    I contributed enough tax, an asylum seeker hasn't yet, I will be the criminal, as I had savings to pay criminal bank interest and fees. What a country we have turned into.

    I feel like you were misadvised by the Job Centre, Contributions Based JSA or ESA (if unwell) would have been more appropriate. They are not means tested benefits like UC.

    However if you failed to declare savings over £6k then that is indeed a problem. Unfortunately the system doesn't allow you to decide what can and can't be disregarded in terms of savings in the bank. Intention to pay mortgage and credit card isn't an allowable disregard either.
