CLAIMING ESA

Hi, ive been off unable to do my job since the beginning of the year, ive just worked out my 28 weeks ssp is up this week , however because i have been with the same employer doing the same job for nearly 40 years, i get up to a year sick pay (worked out by hours , so my HR have told me it ends mid october) so i have been getting my normal salary up to today, im still undiagnosed condition due to not having the best experience with the nhs) but i have been found with at least 2 Hernias. im currently waiting for further diagnostic tests. I have stopped going out leisurely and spend most of the day on the sofa in extreme discomfort/pain as i cant walk properly due to abdominal/stomach area. Does anyone know, now my 28 weeks ssp has ended, although I get the Occupational sick pay from my employer at full pay, will this amount fall or now be reduced. i haven't had a ssp1 form from them, is this something i should request from them now, in order to submit my ESA claim. ? Also, ive asked them for assistance beyond the time when my sick pay ends as i suspect my condition could be related to my employment. Their occupational health partner has indicated i am in such a condition the 2010 disability act applies to myself but im clueless as to what this all means as ive never claimed anything previously, Kind Regards.

    Hi @BrutonStreetTailor I would say that if you're agreement denotes you'll receive full pay for the year, then I wouldn't expect that to decrease prior to that year but it might be worth clarifying with your employer when you speak about the assistance beyond. And yes, it's your employer that will provide the SSP1 form so definitely worth asking about that too. It's good that occupational health are involved. It might be worth seeking some further advice from a third party legal firm as well, if you think it might be an issue created at work to see where you stand.

    Thank you for your reply, they were. Very non- committal, they just said to get a diagnosis, and that is difficult as i do not have private medical insurance, though i definitely have hernias, and there is no way my job can be adapted for me. I am in a trade union, which comes with legal benefits, so think i can wait to see what their attitude and decisions are nearer the end of my sick pay, but il call them this week as am i correct in thinking i need it to claim ESA and is there another benefit UC i may be entitled to ? My wife works part time so i understand that is claimed as a couple. Paul

You could also try the Turn2us Benefits Calculator which is confidential and allows you to pop your details in, and see what benefits you might be eligible for. 🙂

    Hi, so I filled out the forms online after receiving the ssp1 from my employer, and submitted just my latest fit note 3 weeks ago, ( I have 7 from the start of the year since I was first off) Im due to get another one at the beginning of Sept, so shall I send them this latest one also when I get it? , they said they would contact me and i have spoken to them today and they are looking to see if my application will be accepted ? obviously its not just a formality ! I don't understand the differences between what old ESA was and this New style ESA that I have applied for, I have continuous NI contributions from the past 40 years working full time for the same employer so if I understand correctly I will be assessed for Income based, Is that correct and what difference will it make ? The gent I spoke to said there is a 8-9 week backlog and they will contact me if they need any further information, Am I correct in thinking the next stage is they will send me this form 50? is it? to fill out and return ? I took a look online and its full of questions that exhausted me just looking at it. Regards.
