PIP law change Activity 9 mixing with people

Hi,
I received a letter after winning my recent Mandatory reconstruction in which I was awarded 4 points for activity 9. The letter was informing me of the supreme court ruling which details the changes of which descriptor means for the activity. Am I entitled to back pay? I've written a letter anyway but just wondered if anyone had any idea if I had a chance. I've been diagnosed with Autism and ADHD last year (2023) but had my agoraphobia diagnosis since 2010. Here's the timeline of my PIP and the law changes that I could work out.

- I applied in 2018, was awarded daily standard
-Did my MR and was awarded the same
-Applied to tribunal and PIP caved, called me and offered me enhanced mobility with standard daily. I accepted
-I had a review and was awarded the same in April 2020
-the government website says the law change has been considered in all reviews after September 2020
- I triggered a review at the end of 2023 because of my autism and adhd diagnosis
- was awarded the same
- put my MR in and was called by PIP and told they were changing my award to add 4 points to the mixing with other people descriptor and 2 on the managing money descriptor which pushed me into enhanced daily.

Then I got this letter about the law change. With the 4 points, if I had been awarded that in 2018 then I would've always been on enhanced daily and not standard. Me and my partner who is my carer have always maintained that I need social support from him. Do I have a chance? Has anyone else had a similar situation? Thank you for reading. 😊

    Welcome to the community! :) You can call PIP to ask? I believe if there is backpay it comes around 8 weeks after you have won. Hopefully one of our members can confirm this :)

    Hi Hannah, thank you so much. I called with my carer and they put me through to the LEAP team which I wasn't expecting so I passed the phone to my carer. They asked if he is the one who was supporting me with communication back in 2017 too, which he was and explained that we've been best friends since we were 12. I received a text to say the following; 
    'Update on your PIP claim. You asked us to look at your decision again. We expect to look at your case by 15/4/2024. You do not need to contact us unless your circumstances change. Thank you'

    So now I'm just waiting 🥲 wanted to come back and update incase others have the same xx

    I am in a similar situation they have written to say as I scored 2 points for 9b Prompting Iwhich for some reason wasnt put on my file I could have had 4 points which would meant I had an award. They said they have notified Quality Assurance. And they mentioned a law change about social support 9 in 2016 I am confused and wondering if anyone else has been through the process. Thanks
