The lady lied I have not used public transport for 3 years she said I can she said I can communicate with people eve n though I don't go out without my brother I am I. Constant paid. I. My foot since a cident and foot rebus don't u derstant I burnt my arm warming soup I told her still only got 4 point s

    Have you asked DWP for a mandatory reconsideration (MR)?  There is advice on Scope about making mandatory reconsiderations.  Look under Advice and info.  You can also phone Scope helpline who might know about face to face advice in your area.

    Sorry to hear this @trucker02, it must have been very frustrating for you to feel that your condition had been so misunderstood.

    I phoned DWP they have given me 28 days to send in my reconsideration letter do you have to attend court to appeal

    Hi Trucker

    First, do you have your decision letter ?

    Have you requested a copy of the assessment report ?

    You have a month from the date on that letter to apply for MR. Unless you have something in writing from the DWP you should use that as your time frame to submit your MR. The DWP staff on the phone are poorly trained, you can only rely on things that have a paper trail.
    An MR is different to an appeal. When the DWP carry out a MR they should look again at your evidence including any new that you have submitted, and the assessors report. Don't expect there to be any change, it can happen but rarly does.
    The nexy stage is to appeal to the tribunal but you need the MR letter to be able to do this. If you do have to appeal to the panel then it is best to appear in person if at all possible.

    Disability Rights site have a good guide to appealing PIP.  And the Disability Rights Handbook has a good section on tribunal hearings, though you would have to buy this - from Disability Rights site, price £15.
