Lwcra

hi there

I have migrated to uc from income support and carers allowance , I also got severe disability premium

When I went over I had to get help doing the online and the advisor put down my illness.

They asked for a sick note which I got, then recieved a uc50 form

Which I never returned as when I phoned the uc helpline was told I could only get one , carers premium or lwcra, I was also told I'd lose my migration protection because there's a change. They told me I don't have to claim the lwcra so I told them I'm a carer so why send me the uc50 form. She said I can cancel the lwcra so o said okay and she said she would make a note, I also put it in my journal June 12.

I did not return a uc50 form as I just could not take the stress and thought of losing money and proving once again.

However despite all this I recieved a letter for a health assessment video in afew weeks time. I have a hospital appointment that day which I cannot cancel as I don't know when they will give me the next one.

Can someone advise as to if it will mess up my protection money and will I get less?

What will happen if I don't do the interview as either way I'm a carer first for son who has many health and gable delay and autism , epilepsy ect

I would appreciate any advice

Kind regards

Jen

If you are found to have LCWRA then this element will be added to your UC and the Carer Element removed. The reduction in your transitional protection will be the difference between the LCWRA and Carer Element. You will be no better off financially but will be no worse off. If you don't attend the assessment then UC will find you fit for work but as you are a carer you still won't have any work commitments. There may be some advantage in having LCWRA if for example you are going to cease to be a carer at some point. In addition with the changes in the Universal Credit bill it may be better to get LCWRA now. It may be worth contacting CAB or a similar advice agency for further advice,

    Hi Lauren

Just to let you know , I took the phone call for the assessment and was put in the lwcra group. They took of the carers element ,awarded me the lwcra £423

Then deducted the my payment protection money so I'm actually £210 down

im So confused as nothing has changed I was ill before I was transferred to universal credit.
if I did not answer or take the call I would of been better of just being awarded carers

Don't know if this is right or not
    kind Regards hen

Your Transitional Protection reducing was correct.

However it should only have reduced by the difference between LCWRA & Carers Element.

There is a known issue with this change happening incorrectly it is a complex issue, so I'd suggest contacting a trained benefits advisor:

Please see this thread for information on what has gone wrong, and why.

A few other members have been struggling to get the court judgement applied correctly.
