PIP backdated advice

Dear Forum

I was advised in February 2023 to apply for higher rate PIP from an advisor from Veterans UK, who helped me complete my forms.

In July 2023 I had a phone consultation and this resulted in my claim remaining at the standard rate, which I couldn't understand so I appealed the decision, with my first Tribunal hearing happening in November 2024.

The Tribunal agreed with the DWP, but again I appealed as a lot of my information was missing from the Tribunal Bundle and I couldn't understand what 2 female panel members were saying due to hearing problems.

Sorry this is a bit long.

I then had to wait for another hearing date which was held on the 6th October 2025 and have finally been awarded PIP for both parts at the higher rate.

The issue I have, is that it's been backdated to July 2023 and not when I made my claim for a higher rate, in February 2023.

I have spoken to PIP and they have informed me that they have written to the Court to ask why, and that I will have to wait for the Court to give their answer before any backdated payment is given to myself.

I'm being told so many different things to do, such as request the Judgement be set aside and start again or make a new claim, but obviously its been so time consuming and stressful, something which I want to avoid with multiple heart issues, but just trying to get some clarification.

I have advised PIP that if the Court made it as part of the order based on a reason, then I would accept that, but if it's been made in error, then I would obviously like the error to be adjusted.

I had suggested that could I be paid the backdated money from July 2023 with the February 2023 amount either given or not at a later date, but this is dismissed as they said I may end up being over-paid.

But just concerned that it may take months / years as nobody has any idea of the timescale, as for me to wait from February 2023 to get an award has already been a battle that I didn't want to go through.

    Hi @Sarcoid2017, sorry to hear you've been through all this to get your PIP award, that's incredibly stressful. Is it just the backdated payments you are waiting for now? Are your regular payments all set up?

    It might be worth speaking to a benefits professional again to see if they have any further advice to give. You could also try the Disability Law Service helpline. They offer free legal advice about benefits: https://dls.org.uk/free-advice/by-phone-or-in-writing/

    Thankfully regular payments are set up, have been informed will be at higher rate at next payment, but just waiting to see when / if the back dated payments will be awarded, but its about £1600 difference.

    It just seems that you have to be legally trained or certainly trained in answering the PIP questions in order to get this benefit.
