Had my tribunal today and got refused

Hi,

First of all I want to thank this community for all the help you have provided.

I had my tribunal today and because I had it online I could check the outcome on my portal. It says that the appeal was refused and I received 0 points for both daily and mobility. I have no idea how they came up with this decision as even in my mandatory consideration I had listed why I believe I should score certain points and gave examples. I broke down a couple times during the tribunal (video call) and had to take a break and have my mum with me.

The tribunal were so intimidating and kept twisting everything and asking me about stuff from back when I was at college which was over 10 years ago so not at all relevant.

I've emailed them to ask for a statement of reasons but unsure where to go from here, do I apply for a new PIP claim again? I will admit my condition has gotten worse lately, I am often too "proud" to admit how I actually struggle, so that probably didn't work in my favour, but I tried to be more upfront with my struggles in my mandatory reconsideration

    Hi,

    The only way to continue with this claim is to find an Error of Law in the Statement of Reasons. You will probably need someone to help with this as they need to understand the laws precisely.

    If you can't find an Error in Law then this is the end of the current claim and you would have to start a new one. Though if you have been awarded 0 points by tribunal then that would suggest there is a problem with the evidence put forward. So again you may be better off with some help if starting another claim.

    Hi @Anonymous26, I'm so sorry you weren't awarded PIP. The decision often doesn't make sense and it's such a stressful process. Yes, I'd suggest making a new claim too and, as Overly has suggested, get someone to help you. Citizens Advice has some great information about completing the form https://www.citizensadvice.org.uk/benefits/sick-or-disabled-people-and-carers/pip/help-with-your-claim/fill-in-form-pip/ . Try to be honest with your answers and not be 'proud' as you mentioned. I know it can be difficult but it's important that you get the right support.

    @Anonymous26 I agree too with what has been said by members and Rachel. Get help with a new claim and make sure you detail you actual struggles with your disabilities per descriptor. I realise you are to proud to do it, but put proud to one side for the review form! Sorry you has a bad tribunal, there have been a few of late.

    Thank you all so much! I have rang up to start a new claim and will ask for help from Citizens Advice with the forms. I need to be honest about my struggles, I've always been the kind of person to pretend I'm fine even when I'm not so I need to leave thay habit off the forms!

    I understand that took me years to try and take my mask off so good at masking it really becomes a struggle when you left sitting on your own struggling I would suggest get SARS form from gp can requested has all medical information if your mum supports you she can write a letter on your behalf I put years worth of medical notes ie doctors visits therapy to show its ongoing wrote everything from when you wake up till you go to sleep keep a diary list all meds if they effect yoi in anyway its says dont put doctors letter in but I always do yes I have to pay but thats just me goodluck
