Hi I'm stuart 29 year old I'm new to this so if you can HELP. I first sent my forms in on the 20th December 2018 and was refused and in the process of appealing I'm still waiting for my appeal date. I am appealing it as DLA had paid me for 8 years with the same health conditions, probably worst condition now as I've got a hole in my skull where I had a plate but had to be removed in 2018 after getting brain absess. I was wondering i would recieve back pay from that long back if I win my appeal?

HI and welcome,That's a very long wait, although some areas have waiting times in excess of 1 year. May i ask if you're appearing in person? Also please do be aware that PIP and DLA are different benefits, with different criteria. PIP isn't about diagnosis, it's how those conditions affect your ability to carry out daily activity based on the PIP descriptors. If you successfully have a decision in your favour, it will be backdated to the date your DLA ended.Good luck.1

Hi @stuart29 - I'd just like to add my welcome to the community too. I'm sorry to read you're having such a long wait for your tribunal. Appearing in person, as mentioned above, gives you a greater chance of success, so I hope you will do so.If you have any new evidence to support your claim, showing how your daily life is affected, rather than 'just' a diagnosis, then do send it in.Please do talk here any time, & let us know if we can help you in any way.1
