Partner has reached pension age

in Employment and Support Allowance (ESA)
Sorry can anyone help with some advice my partner has reached pension age we are both disabled and receiving PIP  and I claiming earnings related ESA for the both of us I am only 58 years old should she claim her pension or would we be better off leaving thing's as they are had to go through tribunal for my ESA cliam

    Hi,

    As your partner has now reached state pension age then your ESA claim for them should have ended because it's a working age benefit. If part of your ESA is Contributions based then you will continue to receive this (£113.55 per week) If you're still claiming for them then you will need to report the changes.

    Whether you will be entitled to any Universal Credit to top up your income will totally depend on both of your circumstances.
