4 months of nothing

I had my unsuccessful appeal in April, I requested by email for a report of the appeal. We are August now but all I get when I ring is " it's still with the judge" I know they are judges and they are above deadlines but over 4 months to send a report is taking the mick. Do they not realise that they are holding people's lives in their lazy hands. I am waiting to take it to the upper tribunal, my carer was with me and after the telephone appeal she pointed out an error in law so as soon as I received the outcome I emailed them asking for their report. I think judges should be given reasonable deadlines instead of taking their own sweet time. Can someone start a petition to call for this. I,as many have their lives on hold.

    Sorry to hear that this is dragging out for you, hopefully you receive the report soon and don't have to wait much longer.

    No deadline "as such"?? The judge was sent the request 2nd May (2 weeks after the email was sent). Please don't patronise me, I know about the pandemic. It was a statement of reasons I asked for I just couldn't remember what it was called when I put the post up. I didn't mention anything about relatives or friends being hospitalised or dieing unfortunately most of the world is going through that.

    My carer didn't magically identify an error in law she blatantly heard the Dr say something that she checked out on here and other sites, she was open mouthed when he said it before checking it out. If you read my post it was a SOR I requested I just couldn't remember the name of it when I put the post up. Most places have deadlines PIP for instance gives an estimate of 8 weeks, with a judge I was told by a clerk it could take anything from 2 months to 2 years that's not constructive. I used to work for DWP answering calls so I know what the clerks have to face on the telephone and I pride myself in not having a go at them, it's not their fault. As a suggestion for deadlines if the clerk was allowed to say this could take upto 4 months at least people would have an idea of a timescale, even if it went over the 4 months it would be close to being done. As for the month timescale to request the upper tribunal it is, for the moment, scrapped there is no deadline for now.

    Well I finally received my SOR and over 5 pages it's going on about a claim I made in 2014 and the fact that I had things in that claim but not the 1 I was appealing, they are not in the new claim because they don't have as great an effect on my life as they had, I.e. depression and anxiety but   " it is questionable if I had these and other conditions as they are not mentioned in the current claim" I went through hell with my depression and anxiety  and attemped to take my own life a number of times. I had to work really hard but I pulled myself through with the help of my family, I weaned myself off my anti depression so no need to put it in the claim, they took me back to a really hard time in bringing it up 7 years after the fact. There was nothing about the claim I appealed. This was supposed to be a statement of reasons but I can only see historic claims, nothing about what was said and nothing about the tribunal decision apart from award not changed. Sorry if its a bit long winded but had to get it done.

    Hello Kazz3105 I'm afraid the whole process of applications appeals etc is a minefield so I'm sorry you're so stressed about it. If people patronize you or speak harshly to you, please just ignore them, nobody should speak to anyone in a harsh way. Some people take an attitude , even if people understand the system brilliantly they shouldn't be harsh . I hope someone on the forum writes to you helpfully AND gently AND respectfully. Good luck

    It is a fact, they are judge's. Report me for breaching the terms. I can't ignore you don't know how. Go find someone else to patronise

    @Username_removed..Mike, I'm not one for complimenting people on a regular basis, but I'm gona make an exception for you! You may shoot from the hip...but what that 'shot' delivers..is a wealth of knowledge,wisdom,facts and advice....that 'I' for one tune into this Forum for...

    Couldn't agree more. I've learnt so much from Mike in my time here. My daughter and myself both had our PIP reviews within a couple of months of each other just a few months ago. I filled out both forms myself and gave 2 real life examples of what happened the last time that activity was attemped for each one that applied. I used 1 sheet of A4 paper per activity.

    Just over 2 weeks after i returned my daughter forms i receive a decision letter and her award remained the same. About a month after i returned my forms i also received my decision letter and the award remained the same,  so a paper based assessment was achieved for both claims.

    A big thanks to Mike for this because if it wasn't for his invaluable advice this wouldn't have happened.

    It's also worth remembering that it's impossible to read someone's "tone" through a text message. Sometimes it may seem like a person is being a little "nasty or mean" with the replies, when this isn't always the case.

    I agree, this is absolutely something that can be the case on an online forum such as this one, posts can sometimes come across not as they are intended, and it can be hard to judge the true intent with which something is written.

    Which is why we strongly encourage everybody to take care with what they are writing, ensuring to keep it respectful and considerate at all times. It's important to keep in mind who your comment is aimed at, and what they might be going through in their life and what knowledge they may or may not have about the subject.

    I am sure that everybody on this discussion has the best intentions but I'm sorry to see that you don't feel that to be the case @kazz3105. Disagreement and debate is completely fine, however as mentioned it's vital for a constructive forum environment that this is done with the right tone, and with respect for your fellow members. Regardless of how you or anybody else might feel about the comments of other members, personal comments towards another user such as "keyboard bully" are not conducive to a friendly forum environment and I have removed that part of your reply.

    I'd like to remind everybody of our community house rules and the "report" function that is available underneath posts. If you ever read something that you think needs flagging to a moderator, whether it be a breach of the community guidelines or a post that just doesn't sit well with you, please use that function and step away from replying if you don't feel as though a constructive conversation can continue.
