Myself and my partner are both disabled he has just recieved LCWRA, he reported his disability at the start of asr joint claim Aug 14th 2021. So we have waited til now for a answer. But the letter we received is difficult to under stand. Should he get back pay from the 14th of aug2021 til now.

Hi, The other question I'd like to ask is before my partner moved in with me back in July I had been recieving esa with the server and support element in place but because we where claiming as a couple my esa was stopped on the 29th of July 2021 then are uc claim started from the 14 August 2021 should I not of been transferred on to work capability and work related activities. I did tell uc I'd been getting server disability along with surpport element.but no one shorted it out and now I'm still waiting for them to get back to me. I did say when I rang them recently just because my partner moved in it doesn't make me any less disabled. Can any one please help me on this. Thank you.0

Hi,Providing you don't already receive the LCWRA on your claim for yourself because you can only receive it once per claim.There's a full 3 month assessment period waiting time. It's then paid from the 4th month of your claim.Assuming he sent fit notes for the whole time without any gaps the waiting period will be Aug/Sept, Sept/Oct, Oct/Nov. LCWRA starts from assessment period 14th November to 13th Dec and first payment will be 20th December.It can often take a few weeks for them to recalculate your past statements so they can work out exactly how much is owed. Once this is done a letter will be uploaded onto your journal and it will tell you how much they owe you.0

I've just seen in another thread of yours that you were claiming ESA before you claimed UC. Does your UC include the LCWRA element for yourself?. https://forum.scope.org.uk/discussion/90364/hi-my-name-is-nes#latest If so this means your partner will not receive this element for theirself because as advised, you can only receive it once per claim.I also note on that thread you said you transferred from ESA to UC and were claiming the SDP in your ESA. When you moved in with your partner, if you needed to claim for help with any rent or you were claiming tax credits then yes, claiming UC was the correct thing to do. You should also be receiving the SDP transitional support protection on your UC, are you receiving this?0
