Hi everybody I am disabled and get PIP which is used for a motability car I get Housing benefit and I have a HC3 certificate to help with dental costs but I now find I am excluded from the cost of living payment because Housing benefit is the only means tested benefit I claim and I get paid from the council as I am over state pension age.

You are excluded from the £650. You will get £150 for being on PIP, the extra £300 Winter Fuel Payment and the £400 electricity bill credit, and presumably got the £150 from Council Tax earlier in the year. A total of £1000.
I assume you do not get any Pension Credit?

when the council work out my income they deduct £38 off in the calculations because my husband cares for me0

Or possibly claiming Carer’s Allowance or has an underlying entitlement and getting carer premium included in HB calculation,0

The carer premium is because he still has an underlying entitlement to Carer’s Allowance. It isn’t that the CA has changed into the carer premium. The carer premium is separate to CA and isn’t called the carer element, the carer element is a part of a Universal Credit.fisherman said:He used to get carers allowance until he got to state pension age when it changed to carers element
However all of this is not relevant to your question about CoL payment. I only asked in case you might be missing out on anything else. If your joint income (excluding your PIP) is less than £317.55 you would be eligible for some Pension Credit.1 -
