Hi am just looking for a-bit of help, av been getting sick notes since 15 December 21, an i done a medical over the phone an was placed on to lcwra and I got my first payment of this on the 20th of August 22 I received a letter saying if am
entitled to an underpayment I was here back in the next seven days, av now spoke with a case manger am was told there is a 3 month cooling off period and I’ve done that and I’m not entitled to anything else I don’t no if am wrong or he was wrong

You sent your fit note in assessment period 14th Dec to 13th Jan. If you reported your health condition on the same date you sent your fit note then this month does count towards your waiting period because it's not a full assessment period.This means your waiting period will be Jan/Feb, Feb/March, March/April.. LCWRA starts from AP 14th April to 13th May and first payment should have been 20th May, providing you sent fit notes without any gaps up until a decision was made on your WCA.If there were no gaps then the case manager is not correct to tell you that you're not owed any money.1

You can request the Mandatory Reconsideration, which you can do on your journal. They very often get this wrong, which is shocking!
