Hi, my name is anita1973! Will I get my backdated payments from UC?

Hi l wanted to know l applied for universal credit on 7th September 22 (gave fitnote, have had my Assessment and they decided l would get LCWRA) but up to now in my Jan 23 payment l still did not get my money for Disabilities added and also will l get my backdated payments from universal credit. Please can someone Answer

    There's a full 3 month assessment period waiting time and the extra money is then paid from the 4th month after you reported your health condition. Providing you sent a fit note within 7 days of that and continued to send them without any gaps until a decision was made on your claim.
    Was 7th September the date you first applied for UC and did you report your health condition and send in a fit note within 7 days of that? If not what date did you report your health condition/sent in your first fit note and what date do you usually receive your money each month?
    The above assumes you're not claiming UC with a partner that already receives the LCWRA element on your claim.

    I applied on the 7Th September 22
    Put in a fitnote in 21st September 22
    I receive money 7th every month.

    They were already aware of my health, but still had to fill a UC50 form which was submitted on 17th Oct 22 and then on 27th Nov 22 l was told that l will get  LCWRA

    If you applied on the 7th then receiving your payment on 7th of every month isn't possible. Applying on the 7th would mean your assessment periods are 7th to 6th of each month and you should then receive your money on 13th of every month.
    If you sent your first fit note on 21st September than means your waiting period will be. Oct/Nov, Nov/Dec, Dec/Jan... LCWRA starts from assessment period Jan 7th to Feb 6th and first payment for LCWRA would be 13th Feb. No LCWRA element is owed because it's not paid at all during the waiting period.

    Everyone with a health condition that sends in fit notes has to fill out the work capability assessment form.
    That still doesn't change the waiting period, which will be Oct to Jan.. LCWRA starts from AP Jan to Feb and first payment will be Feb 7th no LCWRA element is owed.

    No, you haven't lost anything because as i advised, there's a full 3 month assessment period waiting time and the extra money is paid from the 4th month. It's not paid at all during that time. It's part of the UC legislation and can't be changed. It's been the rules since UC began and the old ESA was exactly the same.
    Regardless of when the decision was made, it would have still be paid from Feb.
    Your decision was made extremely quick and a lot of others are waiting more than several months for a decision so they end up being owed a small amount of money.

    If you were working and receiving earnings since the health condition was reported and you didn't have the work allowance on your claim then you maybe owed some money because of that.

    Thanks for that it's my first time l applied for this for my son as he has lifelong learning disabilities,This is the part l don't understand ( there's a full 3 month assessment  period waiting time and the extra money is paid from the 4th month)

    LCWRA starts from the assessment period in which the health condition was reported. However, because there's a waiting period it means you have to wait that amount of time before the extra money is paid.

    If you had reported the health condition when you first claimed for him and then sent the first fit note within 7 days of that then his first payment would have been January 7th. Because there was a delay in the sending the first fit note then that month doesn't count because it's not a full month. Therefore the waiting period starts from the following month Oct... then ends in Jan. The LCWRA element starts from 1st Jan and ends on 30th Jan and first payment will be 7th Feb because UC is paid 1 month in arrears.

    Unfortunately having a life long learning disability doesn't mean the waiting period doesn't apply. For those that have a terminal diagnosis (end of life) then the waiting period doesn't apply.
