NI Class

Hi there 

I'm on LCWRA and want to claim NI but unsure which class it falls under , is it class 1 or 3 . I've found the claim forms but want to ensure I complete the correct class.

    LCWRA is part of UC. If you report a health condition supported by a Fit Note after 29 days you should be referred for a Work Capability Assessment which will determine whether or not you have LCWRA.

    You can’t just fill out a Work Capability form (UC50) and submit it. You have to wait for UC to refer you for the WCA and a form will then be sent to you.

    UC gives you Class 3 NI credits,

    Ate you claiming UC at the moment?

    Ive been on UC with LCWRA for few years , that wasn't my question . 

    I just want to know what class LCWRA is , so I complete the correct hmrc form. 

    Some benefits are class 1 and others class 3

    LCWRA is part of UC which gives class 3 NI credits towards your state pension only. I don't understand why you're filling out a form, you don't need to claim them yourself.

    Hi Poppy 

    I find the class 3 confusing. 

    Having been on LCWRA for a few years due to heart surgery I'm concerned about my state pension. 

    As you said LCWRA is class 3 , does this mean I need to pay £15.85 per week to ensure there are no gaps

    It states , I'll get class 3 credit automatically, but no contributions have been made on my pension in 3 years

    The credits are applied automatically. However there are frequently delays in applying the credits but DWP say that they will be applied in the few months prior to reaching pension age if they haven't been applied before.

    Unfortunately, chasing 'missing' credits is a nightmare because DWP and HMRC often blame each other. 

    (Curious to know what HMRC form you are trying to complete.)

    You could contact your MP about your concerns in the hope that they become aware of the problem and put pressure on DWP and HMRC to get their act together.

    But doesn't explain why the credits that are due haven't appeared on NI record. The short answer to that is incompetence by government departments which is explored in the discussions I linked to.
