hi all i am michael had a couple of strokes beginning of jan 2022 been left with mobility problems and registered partially sighted live with my lovely dawny who works in peacocks for 16hrs a week was told in hospital not to claim anything for 6 months but have since found out should of  we have been on uc since sept

    Hi my name is Jaide I'm sorry to hear that you you have had a couple of strokes if you want some distraction I would suggest look in the coffee lounge. There's also a section on UC and different benefits section and @calcotti or Poppy are the best people to go to when it comes to all things benefits related.

    I'm sorry you were advised wrongly about Universal Credit (UC), have you now made a claim?

    You could possibly been entitled to some UC as soon as you stopped working if you were only on SSP. You advised you in hospital.
    Six months would be applicable for claiming new style ESA which can’t be claimed until SSP ends.

    hi 2 strokes jan 22 mobility and sight problems put in a uc claim 18th september to october payment was £0 nov payment was £86.91 dec payment was £157.14 jan 2023 was £77.98  feb payment will be £395.64 i was awarded pip 14th dec 2022 at the higher rate for both elements i was due to have the uc assessment for disability in dec but was cancelled due to the person being off sick had the assessment on 16th jan and have been placed in the lcwra group my question is should we have had the disability element included in feb payment i have had a look and it would seem to be just the work allowance

    As you've been claiming UC since Sept then i don't understand the reason for this comment here.

    For the LCWRA element there's a full 3 month assessment period waiting time and the extra money is paid from the 4th month after you reported your health condition. Providing you sent a fit note within 7 days of that and continued to send them without any gaps until a decision was made on the work capability assessment. 

    When it's paid from will depend on what date exactly you reported your health conditionm/sent your first fit note and what date you usually receive your money each month.

    As your PIP award includes the daily living part, if your partner looks after you for at least 35 hours per week then they'll be able to claim carers element of UC for looking after you. They will need to "report a change of circumstances" tell UC that they are looking after you. Your UC maximum entitlement will then include carers element of £168.81/month.

    ah from the stroke dates in jan22 to sept 22 we were not claiming as i was misinformed started claiming uc in sept and gave them all the fit notes and hospital paper work

    If you reported your health condition when you claimed UC in Sept and sent a fit note within 7 days of that and there were no gaps in the fit note then the LCWRA element will be paid from either Jan or Feb 2023. The exact dates will depend on what dates your assessment periods cover or what date you usually receive your money each month.

    hi assessment dates are 12of the month to the 11th of the month payment on the 18th of each month sorry for all the silly questions i get a bit confused

    That means if you reported your health condition when you first claimed UC in September then your waiting period will be. Sept/Oct, Oct/Nov, Nov/Dec.. LCWRA starts from AP 12th Dec to 11th Jan and first payment will be 18th Jan 2023.

    Any money owed will be paid separately to your usual montly money and often takes a few weeks to pay what is owed. You'll also be entitled to the work allowance from the start of your claim, if you didn't previously have this.

    Before they can pay what is owed, they will need to recalculate your past statements to work out what you should have been paid against what you have been paid. You will then be owed the difference between the 2. Once this is done you'll receive a letter on your journal telling you how much they owe and it will be paid into your bank.

    When the statements are recalculated they will replace the existing ones so if you want to take copies of those then you should do that.

    Hi @michael57

    In your case it sounds like it may be worthwhile looking in to claiming New Style ESA as well as Universal Credit.

    Its pays out £509 per month (£117.60 per week) and if you were working in the last 2 tax years you'll qualify.

    The upside is its your personal income and not affected by your wifes at all, so if she starts earning more money then 
    New Style ESA doesn't go down. Or, if you came in to more savings which took you off Universal Credit your New Style ESA will continue because its not means tested (unless you have a pension).

    The downside is it may reduce your Universal Credit to £0 which means you won't qualify for free prescriptions etc...

    You'll need to do a benefits calculator if you can or call an advice agency to make sure.

    There is a time limit to claim New Style ESA. If you leave it too long you can't claim New Style ESA later because you need to have the last 2 tax years NI from when you claim.

    The NI contributions needed will be 2020/21 and 2021/22. Please be aware that if you claim New style ESA and UC together there's no financial gain because the ESA is deducted in full from any UC entitlement.
