Lcwra gap in fit notes

Hi I was recently awarded LCWRA
I have an issue that on two occasions when my fit notes have ended, they did so on a saturday and the doctor wouldn't issue until they run out but when I managed to get the fit note on the Monday they wouldn't back date either so I have a 1 day gap in my fit notes. I know it's probably going to effect my backpay and it's rubbish as I've been handing fit notes in for over a year. Just wondering if they would possibly reconsider considering my severe mental health and the stupidity of the rule with the fit note from the doctors.

I can't imagine that a 1 day gap would affect it, if it does then it's quite harsh in my opinion.

Yeh that's what I thought but apparently they are really strict on fit notes following on from one another without gaps. Just seems like they set you up to fail sometimes, especially when you have to wait so long for assessment and have severe mental health, I struggle to look after myself and remember things on a daily basis so it's been really hard getting the fit notes in for over a year.0

Usually they are strict with larger gaps in fit notes. It has been known many times for them to not be as strict with just a gap of just 1 day.

Oh that's good to know. Hopefully they will disregard then. I was searching a fb page and someone said even 1 day can reset your assessment period.0

Hi Gemma, You are owed arrears for the limited capability for work and work related activity. However, we are just waiting on the specialist team to calculate this before we can issue you the arrears. I have checked the dates of the gaps for sick notes and the arrears you are owed covers them gaps so you don't need to send in sick notes. Thanks Lisa
