LCWRA confusion

Hi all

In relation to backpay for LCWRA, from what I have read, they look at when the condition was reported? What if there is no such declaration but fit notes cover the whole period up to the decision date. For context, I had a telephone WCA in July 2021. In Oct 2021, I was informed of being fit to work. I developed a new condition late November/early December. I did not declare a change in health circumstance but I made my work coach(es) aware of this and continued to provide sick notes. One sick note was rejected after the WCA but all others that followed were accepted.

21 Jan 2022 - Fit notes accepted up until award date from this date.
Fast forward to Sept 2022 - I was informed that a UC50 is on its way (assessment process triggered again).
Nov 2022 - I was informed they have received my UC50
Jan 2023 - I had my face to face assessment
Feb 2023 - Awarded LCWRA.

I'm trying to figure out whether I will be due any backpay or if because there wasn't a declaration as such made by myself - when will the relevant period start?

    When you were found fit for work in Oct 2021 did you challenge that decision? If not then the waiting period will not start from the very first time you started to send fit notes, including the one which was rejected.

    Very odd how you were able to report fit notes without actually "reporting a change of circumstances" then reporting your health condition.

    It will likely be from Jan 2022 and your first payment will be either May or June 2022 but the exact date will depend on what date you usually receive your money each month.

    Many thanks for your response. If, and I say if because I acknowledge that my situation is not typical, I was due any backpay, would they be in touch separately or would I have to chase this up with them? My next statement will generated in a few days time so I will be able to see whether I will have the LCWRA from this statement. If I don't, is it wise to assume that they have decided no backpay is due and my relevant period commences from the day I have been made aware of my award (i.e when I received my decision letter?). I have been awarded beginning of this week (Monday) and my statements have seen no change (yet).

    Arrears are paid separately and can take a while because the amount owed has to be calculated by working out what you were entitled to in each month and then comparing that with what you were paid.

    If the decision has only recently been made and your statement is due soon then they may not include the LCWRA element this month.

    You were right - my statement has seen no change this month. Should I enquire about this with UC or do I wait until our next statement?

    Statement: Sunday 19th

    There probably wasn't enough of time to include in this months statement. As advised, it's not unusual for it to take a few weeks to pay what is owed.
