Pip appeal

Hello just need a bit of advice I have appealed about my pip award & lodged it online spoke to someone at the court & he said to send in the letter which the dwp sent me ( they sent 2 & did say I had to send it to the tribunal) but do I send in anymore evidence yet or wait for reply off dwp if they have to send me or tribunal correspondence0
-
If you have more evidence to send then send it. Providing it arrives with HMCTS at least 2 weeks before your hearing date then that's fine.Have DWP put your new award into payment already?0
-
Thank will do that0

I would like to ask the same as poppy. Have you had your payment started by the DWP yet?Have you had your award letter from the DWP yet?You accepted an offer and the original appeal you made will now be canceled by the DWP so sending more evidence will make no difference and it could confuse matters. You need to wait until payment has been ut in place by the DWP and you recieve the notice from the Tribunal courts that you appeal has been canceled. Then please get advice before you start a new appeal.Nasturtium1

Yes the award letter & payment has been put into place & back pay goes in 15th the tribunal has emailed & said the case is closed & to make a fresh appeal if I wish to do so0
-
Sorry nasturtium my fresh appeal is already in progress with ref number . But any advice is welcome because I only have one chance to get the right award.0
-
It’s impossible to tell you whether you could score more points needed for a higher award because we don’t know anything about your health conditions and how they affect you.1

I know but I am confident with appealing with evidence especially from iidb doctors report & hp mental health assessment which dwp have not seen yet . Just to let you know my arm has severe secondary oa it has hardly any grip is fixed at 45%angle my shoulder has rotator cuff tendinopathy. Dwp have scored me 11points for DL & 8 for mobility I know these won't count at appeal but like I said I'm happy to speak to them & get my points across. But I am glad I took yours & nasturtiums advice & took revised offer0
-
Do you have some idea of where and why you think you should score those points?0
-
Yes since you told me a few posts ago to concentrate on where I should have scored points & not what HP said I meticulously sat down & went through all the descriptors & wrote why & how many days & %of the time they affect me. Like my arm has no supination no pronation no grip so therefore I cannot prepare food eg cut up vegetables use pots pans ovens this would also be a danger to me then there are other things too many to put here like I said the doctors iidb assessment is very much in my favour especially as there is a doctor on the tribunal who would understand how that would affect my Daily living activities1

Hi poppy update on my appeal I had a phone call today from dwp about it & I accepted enhanced rate for daily living & left mobility at standard I am quite happy with what I now get & don't have to go to tribunal thanks for all the advice you gave me & nasturtium1

bcfc said:Hi all about December I put on about my pip decision which came back 0 points on everything I phoned for mandatory reconsideration was met with a rude man as I said. I have since asked for appeal the tribunal sent me a letter with reference on & said dwp have 24 days to reply. then said don't send any evidence yet its best to wait until dwp have responded & sent them & me their report then to send what evidence I have & anything else I want to say. in the meantime I asked for a recording of the individual who spoke rudely to me when I put in for MR because I thought it might be useful for my tribunal appeal. anyway today I get a text message from dwp saying they have looked again & have changed their decision but I have to ring to aggree I find this confusing because why now when all the evidence was there at the beginning & further evidence that I sent.0

It was about a month0

I got a text today from appeals saying dwp have revised my offer in my favour so my appeal as lapsed. I just read on some other forum. That when they sent out the offer letter, they also send a "new claim form" is this true. What's happens now.0

What's happens now.As the appeal has now lapsed it won’t be an “offer letter ” it will be a decision letter, with your award. Now you need to wait for DWP to put that award into payment and pay what is owed.0

Im still a bit stressed (its the effect they have) but yes its great news. I dont have to keep worrying and waiting for an appeal. How long before dwp send the letter/pay the money.0

Is that the same with the letter0
-
Usually money owed is paid before you receive the decision letter. DWP will contact you at some point to ask if you’ve been in hospital or prison and they will do this before paying what is owed.0

Thank you so much for your speedy replies. You're a great help. I was in hospital for 1 day/night. I suppose they'll ask what for too. It was for 1 joint replacement (a couple of months ago) - (still need 3 other replacements and they can't fix my back. I also have other issues). Do you think they'll say that's a change of circumstances. I'm worried it will cause me issues. After all, this is the dwp we're talking about.0
