I have just got my mandatory reconsideration overturned and been awarded the enhanced rate of daily living with 13 points giving me £404 a month.

 
Tips to getting a mandatory reconsideration overturned.

1. Get a diagnosis of the new condition or illness or disability and on this diagnosis get the doctor or professional to say how this effects you as this can not be disputed then by DWP at all because they know if that goes in-front of a tribunal it will be awarded straight away and they know this. 

2. Don’t keep calling up for an update instead just wait for the minimum to call up which is as follows 2 weeks to check it’s been logged 4 weeks if you want to check it’s been looked at and 8 weeks to check the outcome. 

3. Finally in layman’s terms explain why the point/points should be awarded that will give you the enhanced living in my case I was given 11 points daily living and only needed one more point to give 12 points and I showed them that this diagnosis and how it effects me 19 page document explaining my dyslexia & dyspraxia in great detail will give me the 1 more point I need to get Enhanced living.

    Hi Alton,
    First of all Congratulations on your MR.
    Could I ask you, if when you send supporting evidence from family etc, do they just explain what support/care they provide, or is it that they have to incorporate safely,reliably,etc etc.
    Any advice greatly appreciated.

    I would say it would be much better and have more welly if it comes from a DR or professional. 

    I would say get your GP to write up your 
    diagnosis and in that document how it also affects you I sent in with my mandatory reconsideration a 19 page document from a specialist doctor specialising in dyslexia and dyspraxia she was a SPLD specialist and in that 19 page document was great detail of not only what dyslexia and dyspraxia is and how it affects people but also how the condition affects me and that is why I won the mandatory reconsideration and they awarded me 13 points they could not deny that evidence and therefore the CM/DM decided to award me the enhanced rate.

    All I would say is go into great detail if you’re getting a friend or family member to give supporting statements how your condition affects you.

    With all due respect i disagree with that. The majority of the time letters from any GP are not helpful because they don't spend any time with you to see you complete any of the activities related to the PIP descriptors. They will only know if you told them.

    I note that your specialist sent a detailed letter which is most likely what helped you here, this is a completely different league to a GP.

    PIP isn't about a diagnosis, what they look for is how your conditions affect you against the 12 PIP activities.

    A lot of GPs will refuse to write a supporting letter for any benefits claim and those that will agree will likely charge for this.

    Letters from family and others that know you well will carry more weight than a GP. Not forgetting the real world incidents from yourself, detailing the last time you attempted each descriptor that applies to you. With detailed information such as where you were, what exactly happened, did anyone see it and what the consequences were.

    Ok. I’m just saying how mine was and I am only trying to help people but each case is different so no two cases are the same and my GP has done many letters for me I guess it all depends on your GP I have a fantastic relationship with mine and he does all he can to support me. 

    But yes I agree on my case my specialist letter of 19 pages did the job in my case and got me the enhanced rate. 

    What are you applying for? or are you at the MR stage or the tribunal stage?

    If this question is for me then i'm not applying for anything, i've been claiming PIP for almost 10 years.

    Well done on succeeding with the MR.  :)

    I think your situation is different to many others because you needed the 1 point, the DWP probably thought that with the information / evidence provided, you would succeed at Appeal, so made a decision in your favour.

    Now someone with 0 points going into MR, is going to have a huge job to get a decision in their favour. So the DWP know that and are happy to 'bat' that away.
