LCWRA

This was my message from UC BELOW

I've taken a look at your claim and can see that you have been found to have Limited Capability for Work and Work Related Activity (LCWRA).
This means you will soon begin to receive an extra amount of money in your future monthly Universal Credit payments.
When you start to receive this is a bit complicated, so I'll try to explain.
The Decision Maker who decided you would get LCWRA set the date of the start of that decision as 29 January 2023.
From this date you have to serve something called the 'relevant period' - this is a waiting period of three full Assessment Periods you have to serve before we start paying you the extra amount for LCWRA.
To explain a bit more, Assessment Periods are what our computer system uses to calculate how much Universal Credit you will get in a given month. Your Assessment Periods run from 19th of one month to 18th of the following, with payment due to you on the 25th after that. For example, the Assessment Period for the 25 March Payment of Universal Credit was 19 February to 18 March.
As mentioned above, you need to wait three full Assessment Periods before LCWRA will start to be paid:
29 January 2023 start date - falls within the Assessment Period 19 January to 18 February (UC payment 25 February). This is partway through the Assessment Period so does not count as a full Assessment Period.
19 February to 18 March (UC payment 25 March) - Full Assessment Period One.
19 March to 18 April (UC payment 25 April) - Full Assessment Period Two.
19 April to 18 May (UC payment 25 May) - Full Assessment Period Three.
19 May to 18 June (UC payment 25 June) - 1st payment of LCWRA to be paid.
Hope this helps clear that up.

My response sent back to UC BELOW

I understand what you are saying, my first assessment period was 19/12/22 - 18/01/23 of which I was on a sick note already 24/11/22 - 05/01/23, then another sick note 04/01/23 - 03/04/23. I was then required to complete an assessment for capability to work (Jan 2023)... So from what I have read it should commence from the first assessment period? the 3-month waiting period begins when the claimant first provides medical evidence of having limited capability for work - e.g. when they first send in a fit note.

Anyone know what's the correct answer?
    Thank you

I think UC are incorrect here. If you sent your first fit note on 24/11/22 then your waiting period is.. Dec to March.. LCWRA element starts from AP 19th March to 18th April and first payment will be 25th April.

They very often get this wrong which is quite shocking to think they still do not know their own rules. If you don't receive the LCWRA element next month in your statement then you'll need to put a message on your journal under the payment section. In the meatime you do not need to do anything because you could recieve it next month without any issues.

Please note that there was a typo error in the dates I wrote. Your first payment should be 25th April and not 25th May. Error corrected in my above comment.

    Message from UC
LCWRA will show on your next statement which should generate today. The system automatically calculates this.
Will update tomorrow when statement is generated 🤞

It is really positive to hear you have been supported @RJPar. Is there anything else that might help, particularly with it being a long and slow process?  :)

DWP confuse their application or understanding for LCWRA. The way it is worded appears we do not get paid for the first three months. That is untrue. I am in receipt of LCWRA. Sure I had to wait three months for my first monthly payment, approximately two weeks later I received payment back dated from the very first day I made the claim. Hope this clarifies things for you.

This is also not quite correct. For most people when going through the work capability assessment for the first time there's a waiting period of 3 full assessment periods starting from when you first reported your health condition/sent your first fit note. The LCWRA element isn't paid at all during this time. It's then paid from the 4th month.
If you're claiming because of end of life then the waiting period doesn't apply.
If you didn't previously have the work allowance but were receiving earnings during this time then the work allowance is paid from the assessment period in which you reported your health condition. Therefore they may owe some extra money because of this.

    Poppy,
    You are 100% correct.

I worded my input wrong, what I was trying to explain, many people are of the misconception they will not receive any LCWRA payment for the first three months and the claim commences from the fourth month.

When I got paid on the fourth month it was a a lovely surprise to get full payment for the first three months.

Maybe I am just thick, or drunk ( probably both )

This is what you said in your previous comment but you're still not correct i'm afraid. The LCWRA element is not paid at all during the 3 month waiting period. If you already had Limited capability for work (LCW) and this wasn't your first assessment but you reported changes to your health condition then the waiting period doesn't apply.

If this was your first work capability assessment then paying you the LCWRA element during the waiting period was incorrect.

It's also very unusual to be paid any money that's owed in with your usual monthly money. Money owed is usually paid separately because of need to recalculate past statements before any money can be paid.

You can see the UC regulations 2013 here, which explains the LCWRA is not paid during the relevant period, which is 3 full assessment periods. https://www.legislation.gov.uk/uksi/2013/376/regulation/28

I have been so fortunate with the assistance I have received, I would say to our members to reach out for assistance, even if you ask the right questions to the wrong line of assistance, they will always point you in the right direction, just be honest & open with the people you are asking help from......my personal issues are my physical health, that impacts my mental/emotional health & I just don't know how to explain why I feel the way I do......I may try to speak to age concern or mind......but is hard to put the feelings I'm experiencing into words
