@imz
Hi I hope you’re good, I had my appeal on the Wednesday and the next day the welfare rights officer that helped me phoned me to say he got word that I had won. The next day on the Friday I received a letter saying the same.I wish you well.0 -
Hi, I just got the decision, 5 points on daily living which I disagree with still and meant I was 3 points away from getting it
However, I got 10 points for mobility.
I am glad they gave me something, and I don't want to be ungrateful, but I still think I could have scored higher. I think I just had trouble answering concisely. Is this it? Should I give up? I don't assume there is anything further than this to contest.0 -
Interesting that Poppy's earlier comment said they don't have the facility to listen to recorded evidence. Could you expand on that please? I have a phone call recorded with the DWP's full consent which I think is crucial to my appeal.0

You will need to have the recording transcribed for the Tribunal. Though a recording isn’t going to get you a PIP award.0 -
As this was a Tribunal decision you can only appeal on error of law. You will first need to request the Statement or Reasons and Record of Proceedings within 1 month of the date of the decision.imz said:Hi, I just got the decision, 5 points on daily living which I disagree with still and meant I was 3 points away from getting it

I don't assume there is anything further than this to contest.Once you receive those you will need to find someone to take a look to see if they can find the error in law. If they can’t then you won’t be able to proceed any further. You will need an expert to look at those too.0 -
No it might not that's true but when I have it recorded that a DM admitted she didn't know where the evidence had come from or when it was received but still used it to keep the MR the same, I don't think it looks good for them!poppy123456 said:

Yet the most likely outcome of any MR will be the decision remains the same.trb10 said:

Though a recording isn’t going to get you a PIP award.As you’re now at Tribunal stage, what you should do if you haven’t already is give a couple of real world examples of exactly what happened the last time you attempted each descriptor that applies to you. Adding detailed information such as where you were, what exactly happened, did anyone see it and what the consequences were. You should aim for at least 2 examples per descriptor that applies.Remember they will not take into consideration any worsening of condition.0
