Hello , i wonder if someone with some knowledge of universal credit and inheritances can help me.

The best part of a couple of years ago i was in the LCWRA group as i have struggled with my mental health for the majority of my life, i was lucky enough to receive an inheritance that was a fair amount greater than the £16000 allowed while on UC. I immediately reported it and asked for the DWP to close my claim as i was able to financially support myself. 

Over the course of first year following closing my claim i worked hard on my mental health issues and for once in my life had great success and even managed to get myself back into work and start a evening college course along side the job to try to re educate myself ,life was the best its ever been then i became ill physically with a health condition to do with my stomach ,not wanting to give up i tried my hardest to stay in work (a self employed role) but my illness was to much and i was in pain more often than not and it ruined my mental health again and have found myself back at square one with terrible mental health ,my inheritance exhausted from old debts and the cost of supporting myself and with no where to turn i found myself having to reply on tops up from UC whilst self employed until finally i became to unwell to work , my doctor has signed me off and am currently in a waiting list to be seen about my condition at a hospital clinic appointment. 

Does my previous inheritance of 22 months ago effect my ability to claim now even though i have nothing left ? the DWP have contacted me about a compliance interview and it mentions about the time before my recent claim and that there is gaps in my employment but that was from where i was supporting myself with the inheritance that i was left is this going to be an issue with the DWP ?

    As the inheritance was a fair amount over £16,000 then they are very likely contacting you to enquire about where the money was spent and yes they can do that because you were claiming UC before you had the money.

    Paying off debt isn't classed as deprivation of capital and providing you didn't spend it on the most expensive things then it should be ok. However, you will need to wait for a decision maker to make the final decision.

    They maybe asking about your employment to determine if the benefit cap will apply to you now. There is a grace period of 9 months if any of the following applied to you.

    • you’re claiming Universal Credit because you stopped working or your earnings went down
    • you’re now earning less than £722 a month
    • in each of the 12 months before your earnings went down or you stopped working, you earned the same as or more than the earnings threshold (this was £658 up to 10 April 2023 and is £722 from 12 April 2023)

    Hello @MarcKeirle. I hope @poppy123456's detailed reply has helped you understand why the DWP might be contacting you with a compliance interview. I'm glad you've been able to speak to your doctor about how you're feeling and hopefully you won't be waiting too long for your hospital appointment.
