edited June 2023 in Universal Credit (UC)
I'm new to the communty.  Hello everyone.

I don't know much about LWC benefit.  I had a decision letter and was refused /LWC early June 2023.  However, in my journal the decision maker did say the recognised my condition, but would be able to do some form of wk. I would like to ask a couple of questions.  I would like to do a mandatory reconsideration, but have nothing to challenge it against.   I wk 2 days a week and cannot manage anymore due to increased pain.

1.  Is the reason for decline supposed to be stated in the decision letter, as I cannot see the reason?  It all looks like a generated general response.

2.  I have telephoned the no. on the decision letter and requested a copy of health assessor's report.  No-one can tell me how long this takes to arrive.  Does anyone know how long?

3.  I have asked for a statement of reason from UC because I don't know who many points, if awarded any or their reason.  They said someone will contact me anytime upto 5th July 2023, one day before I supposed to submit a mandatory reconsideration.

Please can anyone shed some light on this?

The decision letters are always very basic and don't usually give any specific information. There will be no statement of Reasons available from DWP because this only applies for a Tribunal decision.

For the MR you need to state which group you think you should have been placed into and your reasons why. Have you had a look at the descriptors for both LCW and LCWRA? If not then you can see them here.

LCW, for this you need to score at least 15 points. There's no extra money each month for this.  https://www.benefitsandwork.co.uk/universal-credit-uc/uc-faq/limited-capability-for-work

LCWRA for this you need to satisfy at least one of the descriptors the majority of the time. https://www.benefitsandwork.co.uk/universal-credit-uc/uc-faq/limited-capability-for-work-related-activity

When you do receive the assessment report you shouldn't concentrate wholly on this because this isn't going to find you to have either LCW or LCWRA. Concentrate on the reasons why.
