Capibilty for work

Hi there, I have been signed off since July 2020 by the doctor a mental disorder. Two weeks ago I sent off my capability for work assessment. I have always had fit notes since then to cover it since now I have only been on universal credit. Would I get backdated with capability for work since I first handed in my fit notes in two years ago.

    That's an awful long time to be waiting for the form. Is this your first work capability assessment?

    Yes this is the first time I have gave the form back to the capibilty for work office. Or had one. I was just wondering if I would get back pay from when I first handed in my fit notes to universal credit from my doctor

    If found to have LCWRA then you'll be awarded from the date you reported your health condition. Then there's a 3 full month assessment period waiting time before the element is paid, it's then paid from the 4th month of your claim.

    When it's paid from exactly will depend on the exact date you reported your health condition, providing you sent a fit note within 7 days of that and continued to send them without any gaps until a decision is made on your claim. Also it will depend on what date you usually receive your money each month.

    LCWRA element isn't paid at all during that waiting period.

    All I filled out and sent back last week was. Capibilty for work assessment... NOT LCWRA... 

    And I will find out if I'm getting it with in 4 - 6 weeks. 

    I was just wondering if it would be back dated till I first started sending in fit notes.

    As you only returned the form last week then it could take longer than that for a decision. Most people have assessments which are mostly by telephone. Some are face to face or video call. If an assessment is needed you will be contacted.

    Yes i know it's a work capability assessment. If the decision is Limited Capability For work Related Activity (LCWRA) then as i advised above, you will be entitled to extra money from the 4th month after you first reported your health condition. The extra money isn't paid from when you reported your health condition because of the waiting period, which i explained above.

    If the decision is Limited Capability for Work (LCW) then you won't be entitled to any extra money.

    The doctor has signed me off for another year till July 2224 at the earliest. So that is why I believe it's not. LCWRA.

    You are not understanding what the work capability assessment is about. 

    Once a decision is made it can be either LCW, LCWRA or fit for work. A fit note isn’t proof you have limited capability for work anyway.
