Refused car on motability

So I applied for the motability scheme, went through the whole thing.
Then was refused, rang them up and told it was due to something that was on my licence but actually expired I think 1 or 2 years ago it just hasn't been removed yet.
I let my partner drive my car, I had just got my policy on compare the market and did one quote with him as named driver and one with me and one with out him, anyway we was pulled over and I am not sure how but guessing I must of clicked the policy without him as named driver so he wasn't insured. So he was charged with in10 I think or in20 and I didn't think I was, turns out I was charged with the same thing as I should of checked.  
It is driving without insurance. 
I have tried to see about getting it removed as I say it is spent.
My question is how do I appeal to see if they will still give me one as it literally comes off on 18th November. 
Or can I get someone else to drive it as is my carer?

    Assuming you received points on your license for this then they will automatically be removed when they are no longer valid. How long they stay on there for will depend on what exactly the offense was for. https://www.gov.uk/penalty-points-endorsements/removing-expired-endorsements-from-your-driving-licence

    If they are due to be removed from 18th November then you can try to join the scheme after that date and be named as a driver.

    You can usually have a carer as a named driver, however they may still refuse your application to join the scheme until the endorsement is removed. I'd advise you to ask motability itself.

    The minimum time from date of conviction is 4 clear years. If you were convicted of a more serious offence it will be 11 years.

    Hi @leanne348, welcome to the scope community :) Sorry to hear about the issues you've faced getting a motability car. IN10 is for driving without insurance against third party risks and stays on the licence for 4 years. 

    I would follow what Poppy has said, and if it comes off your licences on November 18th then re-apply after that point and you should hopefully have no issue!

    Just checking this again and IN10 is 6-8 points. It's possible that RSA insurance will refuse to insure you even after the points are removed. 

    Drivers with certain motoring convictions, licence endorsements, fixed penalty notices or disqualifications within the last five years will not be allowed to drive your vehicle. For this reason you may have to wait until 5 years after the conviction. RSA will be able to give you move information.https://www.motability.rsagroup.co.uk/who-can-drive-your-vehicle

    Just a point - Motability no longer have RSA as their insurer - it is now Direct Line.

    The poster would have been charged as 'aiding and abetting' another to drive her vehicle. She could have said that she had not given permission for him to drive it thus having him also charged as taking the vehicle without the owners consent. She would have been in the clear with no points and he facing a more serious position.
