LCWRA

Hi, I'm New here also claiming UC for first time, I need some help and advice about my benefits.
I first claimed my UC on 26/12/2021 and I got my first pay out on 01/02/2022 until 01/06/22.I started working from May 2022 till Jan 2023 during that time I have been sending in fit notes which expires Jan 2024. My UC was restarted from 01/04/2023. Due to my mental health I was told to give fit note in,so I gave my first fit note in starting from 30/01/2023 continue till today which runs out on 02/01/2024.
I have also been awarded PIP from April 2023 @ Enhanced Daily Living and Mobility Component.
I received UC Health Assessment form on 02/07/2023 filled it and sent it back on 25/07/2023 I had my WCA Telephone Assessment on 15/10/2023 and on 19/10/2023 decision was made to grant me LCWRA.
I like to know from what date my LCWRA will start and will it be back dated, I normally get my UC pay on every 1st of the month. Thanks Kind regards

Hi,
Thank you for your reply could you please clarify 91 days waiting period for LCWRA does this mean 91 days from when we first submitted the fit note which was on 30/01/2023. So my understanding is that from 1st of May 2023 should get back dated payments. Thank you

You said you gave your first fit note on 30th Jan 2023 but then said you restarted your claim on 1st April 2023. How can you give a fit note if your claim didn’t restart until April? Was the fit note backdated?0

Hi Poppy12345,
Sorry my mistake I meant to say was first payment was made on 1st of April 20230 -
That still makes no sense that you sent your first fit note in January 2023, that’s wouldn’t have been possible if you weren’t claiming UC at that time. Was that fit note backdated? If it was then they don’t usually accept this and your waiting period is highly unlikely to start before you claimed UC again.Did you actually report the fit note when you claimed again? You can check back through your journal to see exactly what date you reported it. I can’t advise without more information.0

Hi Poppy123456
Sorry I apologise for all the confusion let's start again I first claimed UC 26/12/2022 to 03/05/2022.
That's when I started working UC was still active but I wasn't getting payment because I was working.
I went off sick 20/01/2023 and was claiming sick pay from my employer, last sick pay i received was on 18/02/2023.
Because UC was still active I sent my first sick note to them on 30/01/2023 and to my Employer.
As I was getting sick pay from my employer from 28/01/2023 till 18/02/2023.
UC sent me a message saying "UC will start once earnings stop being reported to us. UC restarted on 01/04/2023.
I hope this makes sense. Once again I do apologise.
Regards

Thank you, that make much more sense. This means your waiting period will be Feb/March, March/April, April/May… LCWRA starts from assessment period 26th May to 25th June and first payment will be 1st July.If you didn’t previously have the work allowance they will owe you some money because of the earnings. This will apply from assessment period Jan/Feb.Money owed will be paid separately to your usual monthly money and often takes quite a few weeks to pay it.0

Hi Poppy123456,
Sorry to be a pain could you please clarify from what date should I get the payments. According to UC they said 91 days from 15/10/2023 which takes it to Jan 2024.
I received UC Health Assessment form on 02/07/2023 filled it and sent it back on 25/07/2023 I had my WCA Telephone Assessment on 15/10/2023 and on 19/10/2023 decision was made to grant me LCWRA.

You have been advised incorrectly by UC. If you provided fit notes without any gaps for the whole time then the waiting period starts from when you provided your first fite not. Not from when the decision was made.Your waiting period is as i advised here.poppy123456 said:This means your waiting period will be Feb/March, March/April, April/May… LCWRA starts from assessment period 26th May to 25th June and first payment will be 1st July.0

Hi Poppy123456,
Thank you for your sound advice.
So should I contact UC to get the exact date for payment. Thanks once again0 -
Send this to them. ADM chapter 5 https://assets.publishing.service.gov.uk/media/649acab22caa3e00133e5f3b/admf5.pdfRelevant period
F5031 The relevant period is three months beginning1
1. in relevant threshold cases2 (where the claimant has weekly earnings at or above the relevant
threshold and is entitled to DLA or PIP), on
1.1 the first day of the award of UC or
1.2 if later, the date on which the claimant applies for the LCWRA element to be included in the
award or
2. in any other case3, on the first day on which the claimant provides medical evidence of LCWThe part in bold above, medical evidence means "fit note"

Hi Poppy123456

My question is if I request MR will they look at my claim again and could lose my LCWRA. Thanks.

No, but you need to make sure you tell them that you're requesting the MR for the waiting period only.
