Just moved in with my partner he is on esa support group and pip am on long term sick can you help what we would be entitled to please 😊

    Which ESA is he claiming, is it Income Related, the old contributions based or New style?

    When you say you're on long term sick, are you being paid sick pay from your employer and does that include SSP? or claiming benefits yourself? If benefits, which ones exactly please?

    Hello @Jayne1984, welcome to the community :) First of all, congrats with the move! I imagine that's a big step, I hope it's all gone well so far.

    About your entitlements, it does depend on a few things like Poppy has mentioned.

    He was on esa sdp they have took the sdp off him because i have moved in and put him on esa supprt group and we have put a claim in for uc will he automatically get the 390 on uc

    Yes the SDP would have stopped when you moved in, unless you were also claiming a qualifying disability benefit or registered blind. 

    For UC he will be entitled to the LCWRA element from the start of your claim.

    If you care for him for at least 35 hours per week you will be able to claim carers element of UC for looking after him. If you didn't report being his carer when you claimed then you can log into your journal and report a change of circumstances. Then click caring for someone and report it through there. Your UC will then include carers element at £185.86/month. 

    If any part of his ESA is contributions based this will contact (£129.50/week) but it will be deducted in full from any UC entitlement.

    So will he continue to get the esa and get the luwra at the same time

    ESA will only continue if part of it is contributions based, as I advised above. If not then it will stop. 

    For UC you will be entitled to the standard couples allowance, LCWRA element, carers element and any other additional elements you are entitled to.

    Thanks very much for giving me advice i really appreciate it . Can i just ask you am on long term sick from work still classed as employed but not getting any money what am i entitled to claim .

    You're welcome. You've made a claim for UC as a couple. You can look at claiming New style ESA which is a contributions based benefit only. To be entitled to payments for this you will need to have the correct NI contributions in tax years 2021/22 and 2022/23. 

    However, if you claim ESA as well then it's deducted in full from any UC entitlement as there's no financial gain to claiming it. Though it can be worth claiming it if entitled because it could come in useful in the future because it's not means tested like UC is. 

    I should also point out that if you claim ESA. once you go through the work capability assessment, if you're placed into the Support Group then you will not receive any extra money from UC. This is because you can only receive 1 LCWRA element per claim. 

    Are you claiming a disability benefit such as PIP/ADP or DLA? If not and you're not living in Scotland then you can look at claiming PIP.https://www.citizensadvice.org.uk/benefits/sick-or-disabled-people-and-carers/pip/ 

    If you're living in Scotland then it will be ADP. 

    If you're not claiming any benefits currently and you're no longer receiving any earnings from your employer, how have you been able to support yourself up to now?

    I'm assuming you do not have capital/savings of more than £16,000 otherwise you'll both be excluded from claiming UC.

    Hiya poppy i am not receiving any benefit or earnings i have found it hard family and friends have been supporting me . I have had my job for 20 years i am on the sick because i have injured my self at work my solicitor is dealing with it . I have had to have back surgery and i have chronic pain from my shoulders to my feet now .

    I’m ok, thanks for asking. That will be his review starting for PIP. He will receive the review form in the post within the next 2 weeks.

    He will need to make sure he fills it in and return it with any supporting evidence. Make sure he treats it as a new claim. He can ring PIP to ask for extra time to return it and they will give him a couple of extra weeks.

    Thanks poppy for your help. How are you ? I have a question to ask you me and my partner is on esa and as been award lcwra and on Journal, this has cone up will it affect what we get now x
