How long now - tribunal

in PIP, DLA, ADP and AA
Hi so ive been waiting since July time 2023 for a telephone hearing with tribunal. I know that nobody has a timescale for me but I'm really hoping to have an appointment soon, how long has everyone waited for there's? I keep being told I'm on a waiting list my bundle of evidence is like 5 inches thick and I've added more evidence since last year so could that be the reason why there taking so long with the amount of evidence I have?

    Potentially 10+ months but possibly as long as 1 year after requesting the Tribunal. Please note that with evidence, less is often more and sending multiple pieces of evidence all saying the same thing isn't helpful.

    @poppy123456 my evidence isn't all the same thing its all what I struggle with daily and new evidence I have been given from doctors ext. I've recently had operation on my foot for excision coalition lateral cc and I've gave In letters from that. I wouldn't give in the same evidence

    Is that surgery related to how your conditions affect you at the time the assessment took place? They won't take into consideration any changes or worsening of condition since that time.

    Hey hun I’m the same, I applied last feb 23 it got declined so I did a MR which was also declined so in June/July I appeal to tribunal and I’m still waiting. I’ve emailed the courts and they keep saying it’s ready to list just waiting on a judge to arrange a date and time. It’s making me worse I struggle with my MH and the anxiety and panic this is causing is making me think shall I just pull out.

    That's exactly how I felt just give in pull out, and I would of done if everything was not backdated, as what is the point keep positive, just indicates how many people are declined and appeal

    That’s the only thing that’s stopping me we I could do with the backdated so I can pay for hypnotherapy and go private for my adhd as I’ve been waiting over a year for my assessment xx

    MR no change then applied to tribunal in August.
    I've now spoken to my local mp but not sure if it will help but anything is worth a try.
    Hopefully not much longer. My mental health and physical health has had a bashing over this and I think it's massively wrong to keep people in limbo like this. New claims seem to be much quicker now so it seems like we are just stuck in the back haul.

    It’s such a disgrace isn’t it. I have also seen a lot of new claims been done very fast it’s just not right at all. What has your MP said ? I’m thinking of calling CAB for some advice as I keep geting the same reply from the courts to say “it’s ready for listing” my anxiety is through the roof it’s making me so much more poorly. I just don’t no what to do or how to go about geting a answer.

    Snap. She said she would look into it but it's only been a few days. She replied straight away so that's a bonus. I'm the same can't sleep , keep dreaming that I lost a tribunal and had to start again. It's mental torture and that's exactly what they want to make you withdraw your appeal but I'm gonna stand my ground I've come too far and not letting the flawed system beat me.

    This is so true hun it’s just so so draining isn’t it I’ve become so much worse since I applied and been sending all evidence in just got a horrible feeling and it really grates me that I no of people that have been accepted and don’t even need it 😩

    I gets you to thinking that you don't deserve it doesn't it, the worst is what the dwp put on the forms to the courts like its someone else. I'm assuming it's all cut and paste as no thought has gone into it. They lost my medical notes so I just copied them and sent them directly to the court. They based my claim on no evidence as they say they didn't get it.

    What I cant understand with it being flawed and things are not written down what u say etc it's lieing  why has this not been looked into, but if a person lied they would be accused of trying to obtain a benefit illegally, I honestly feel if a person proves a health condition it's only logic how that health condition effects there life  1 good point I have addressed the tribuneral is this, I agree a health condition on its own does not award points, however looking at a health condition as in its severity, mild moderate severe is also important, as 1 person with mild and 1 person with severe who have the same condition will effect the in different ways only logic, so I believe it's very important to go into a person's health condition then hiw the severity effects their life

    Oh wow they lost your medical notes (or did they just disregard them) there are so bad at hiding things and lying. If my case is rejected again I will be taking it further. What more can we send to prove we are eligible to claim the support we are entitled to. It’s such a kick in the teeth it really is xx

    New claims are totally different to those waiting for Tribunal hearings. It can take at least 10 months for a hearing date from when you request the Tribunal. 

    You can contact HMCTS and ask them what the average waiting time is for your area and they will tell you but it's just a guide and doesn't mean you'll receive a date within the timescale.

    Jon it's an awful process to have to follow I'm still sending evidence now to make sure they can't hide anything. As we all know it's not about diagnosis but they say you haven't provided evidence like medical notes? It's very contradictory just like the assessment paperwork.

    Agree but in theory if you give permission for them to veiw your medical history like I did then no need to send anything  they prob won't as they know u are being honest and if they do cherry pick the things that go in their favour, it's all a legal game, judges although human have good instincts it's not just evidence they go off its the inconsistency of a individual, deffinally not be a pleasure to stand in front of a tribuneral, however it's rare for the dwp to do that I wonder why,?

    Sorry but you are wrong if you are saying there is no need to send anything if you give permission for them to check your medical history.
    If you have any evidence you should send it to the dwp because they won't award you without evidence

    They very rarely contact anyone for any evidence. The onus is on you to prove you qualify, not theirs. This also applies to Tribunal stage, which you're at right now. As I advised in a previous thread of yours, you do not need to send anything you've already sent because DWP will send everything to the Tribunal.

    Jon is at Tribunal stage so any additional evidence should be sent to HMCTS, not DWP. You don't need medical evidence to be successfully awarded PIP. Many people claim it without providing any medical evidence.

    You are correct I should have said send to the tribunal.
    I wasn't saying you need to send medical evidence to pip I was just saying you need to give the evidence that you have got which could be your application form.
    It doesn't need to be medical evidence I agree
