Carers element?? Help please

My daughter is autistic and so am I, my daughter receives higher rate DLA, my issue is I also suffer from anxiety and depression, can I be her carer

    Carers element is part of Universal Credit. Are you currently claiming any benefits, if so which ones exactly? Are you working?

    Which parts of DLA is she claiming? There's 2 parts, care and mobility.

    Yes you can claim carers element for looking after her. The only issue would be if you reported your health condition and went through the work capability assessment yourself. If found to have LCWRA then you can't receive both carers element and LCWRA element yourself. In this case the higher element would be paid and that's LCWRA. 

    Have you reported your health condition and provided fit notes? This will start the work capability assessment process off.

    Hi there, i haven’t reported my diagnosis to universal credit and my sick note at the moment is for caring responsibilities for my daughter

    You don’t need a fit note for caring for your daughter and they won’t accept that.  When you claim carers element you will not have any work commitments anyway.

    A fit note would be needed if you report your health condition.
