Income support to UC

Hi everyone,

Recently I got migration notice letter that I have to apply to UC from income support.

As I got standard pip with both components many years ago and also get disability premium £42) Severe disability premium(£81)On top of my income support . Now if I apply UC will i lost those payments?

I am totally confused

    There's no disability premiums payable when claiming UC. When you claim UC your maximum entitlement will include some Transitional Protection. TP is paid to those that are worse off when they claim UC.

    You must make sure you claim UC by the date in the letter. If you don't then your existing benefits will end. Are you claiming carers allowance?

    thanks for replying . No I didn't claim carers allowance. So I will be worth off in UC. Is that right?

    Is the reason you're claiming IS because you have a child under the age of 5? I note from a previous thread that you have a child that claims DLA, does that include mid/high rate care?

    No, you will not be worse off when you migrate across, that's what the Transitional Protection is for, so you won't be worse off.

    Sorry for all the questions but I'm just trying to find out your situation so I can give the correct advice.

    i have a nearly 3 years old child who was eligible for dla from birth but I didn't claim because I didn't know how to claim and he recently got lowest care component and additional on his child benefits.

    Thank you. As your child only claims low rate care then you will not be able to claim carers element of UC. For this reason you will likely be expected to look for work because your PIP award doesn't automatically entitle you to limited capability for work.

    You can ask for a reasonable adjustment due to have a disabled child aged 3 but it will be down to a work coach to make that decision. (I do not agree with this at all)

    You can report your health condition when you claim UC and provide fit notes to support this. You will then be referred for a work capability assessment. The only issue here is that if found to have LCWRA then you may not be any better off financially because if other elements increase or you become entitled to other elements, the Transitional Protection decreases. In this group you will not have any work commitments so won't be expected to attend any appointments or look for work.     When you submit your claim for UC your Tax credits will end. Your Income Support and housing benefit (if you claim that) will continue for 2 weeks and then stop.

    Your first payment for UC will be 1 month and 6 days after you submit your claim. You can request an advance payment but this will need to be repaid back and your future UC payments will be reduced.

    Thank for your help. I am waiting for hip replacement surgery and during those years that I was on pip my situation got worse then before so I probably need knee replacement in the future also but my son got better then before he just need extra care. Thanks again

    You will be able to claim once you've had your first appointment. Don't forget you will also have 2 weeks of Income Support payments once you claim UC.

    so if found not fit for work and your entitled to TP due to being on income support with added disability premiums r you worse of if they find u unfit for work or payments kind of the same if that makes sence
