Hello, received migration notice and will be migrating from income support and tax credits, question is I receive the disability premium on my income support what happens to this in regards to lcwra will it transfer over or will I need to provide fitnotes, letter says will be covered by transitional protection, iam also a carer, any help appreciated, thank you

    Are you claiming Income Support with a partner or just yourself? If with a partner, is it you claiming carers allowance or your partner?

    There are no disability premiums payable when claiming UC. The disability premium for IS is irrelevant for the LCWRA element. For this you will need to report your health condition and provide fit notes.

    When you migrate across you won't be any worse off because there will be TP in place.

    Yeah claim with wife joint claim we are both receiving carers allowance, so if I don't notify them of my disability will I still receive what iamgetting currently, so confusing, thank you so much for the reply poppy 😊

    You're welcome and thank you for answering my question. When you do claim UC you will each need to start a claim, then one of you will receive a linking code to join both claims together.

    When you're filling out the form you both need to make sure you tell them that you're a carer. Your UC will then include 2 carers elements. Your carers allowance will continue to be paid as it is now but be deducted in full from your UC, like it is with your IS.

    As you're both carers you will have no work commitments but you maybe expected to attend your local job centre for your first appointment. After that, no further appointments will be needed and your only commitments will be to agree to report all changes.

    You do not have to report your health condition but if you do then you will need to provide fit notes and continue to provide them until a decision Is made on your work capability assessment.

    If found to have LCWRA then you'll be entitled to extra money from the 4th month of your claim. However, those that are receiving LCWRA can't receive carers element at the same time and in this case the higher element will be paid, which is LCWRA. You can also only receive 1 LCWRA element per claim so both of you will not be able to receive it.

    There is another downfall to the LCWRA element here, if your UC includes TP then if you become entitled to other elements or other elements increase then your TP decreases until such a time is erodes completely. This may mean that you may not be any better off by going through the WCA process but it will depend on the exact figures.

    When you do submit your claim your first payment will be 1 month and 6 days later. You can request an advance payment but this will need to be repaid back so your future payments will decrease.

    Thanks for the information poppy, grateful for your time, just to confirm the housing benefit runs on for 2 weeks aswell as the income support?
