What award does he currently have exactly?
For high rate care he must need both day and night time care needs. For middle rate care it will be either day or night time care needs. See link

hello my son doesn’t have any awards he has optic nerve hyplasia he is blind in one eye and sees blurred in the other , he has a magnifier at school and sits at the front of the class when he goes to the toilet I have to clean him after as struggles to clean him self up he doesn’t struggle mentally but physically he trips over and walks into objects and don’t want to go into every detail but I had a call from dla and the lady just said he doesn’t have higher care needs but he does he knows how to move around his class as it doesn’t get moved around and it’s familiar to him but he does fall all the time and sits at front on the class he has a sensory team that goes to the school but he doesn’t have a ehc plan as he didn’t need one

Oh, I assumed that because you said you were applying for higher rate that he already had an award.
Have you ever challenged that decision by requesting the Mandatory Reconsideration. (MR) Then Tribunal if the MR decision doesn't change. If not, is there any reasons why?
To constantly reapply using the same evidence you previously used will likely continue to see refusals. Best route is to challenge that decision.

hello thank you for your response I have asked for the reconsideration and I sent an extra letter this was 10 weeks ago I had a letter two days ago saying there still looking at claim I will keep pushing foward this time as I have done this mandatory reconsideration before but I find it really hard to explain things as to me it’s normal but everyone around me notices and since my brother has his son there is a massive difference that I didn’t notice before as my son is my only child , thank you for advice
