Hi we have just received our migration notice to go over to uc but I'm worried as we are due to move very soon to a completely new council my uc claim will be submitted before our moving date so my question is would I lose my migration protection if I move as it would be classed as a change of circumstances thank you

    Moving house is not a change of circumstances that will affect any possible Transitional Protection. Unless you're moving in with a partner. Or if you claim for help with any rent and your housing element is more in the new house than it was where you currently live.

    You also have 3 months in which to claim UC so if you're due to move before that you could wait until you move to claim.

    Hi the rent is higher in the new property so dose that mean I will lose my TP

    Not if you wait until you move to claim UC.

    Please remember also that not everyone is entitled to Transitional Protection. It depends on the figures between your current benefits and UC. If your maximum entitlement of UC is less than your current benefits then you will be entitled.

    I'm not able to wait unfortunately as we have the migration notice for 30th October and we don't move till middle of November

    You said you’ve only just received it. You have 3 months in which to claim UC.

    Once you claim UC and Transitional Protection is calculated it erodes when other elements increase or you become entitled to other elements. Housing element increases will erode it, whether you're renting from social housing or privately.
