LCWRA Overall time frame

Apologies in advance for the long message however don't want to leave any details out. So I put my first sick note in on the 5th November 2023 but was sent the UC50 form on the 5th January 2024. This was completed and sent back on the 8th January but confirmed by my work coach that it wasn't recieved until 8th February24. From this i had to chase it up in May 24 as heard nothing back not even about an assessment to be told its with a decision maker. I questioned at this point why I'd not had an assessment but was told this wad the outcome. So I waited some more... July 24 still nothing so I again chased this up to be told the same as before its with a decision maker. In Late August I had to take this higher with senior management as I still had not heard anything. I was then called on the 21st August 24 to be told that the form had not been sent over to the health team on time and this was my error. After going through my journal and evidence of everything it was agreed on the 28th August it was not my fault at all and sent over to the health team. I then had a call on 8th September to book my assessment which was on the 8th October 24. I am awaiting a response from this.

My question is if awarded - will the claim be backdated from the 14th week of my sick notes which I believe would be March 24 as appreciate first 13 weeks are the 'assessment period' at the beginning of the claim or is there a limit on the amounts as evidence shows the delay was not my fault.     Did you stop putting in fit notes at any point? As far as I'm aware, there's no limit on the backdated payments, but they do need all the fit notes to have consecutive dates with no breaks.

    I dont understand the part where it wasn’t sent over. The forms are always returned straight to the assessment providers and not to DWP first.

    If found to have LCWRA and there were no gaps in your fit notes and it’s Universal Credit you’re claiming then it’s paid from the 4th full assessment period after you provided your first fit note.

    The 13 weeks apply to ESA only.

    Thank you both for your comments so can confirm there was never a break in fit notes being supplied. And still is not to this day... My UC coach advised that the forms are sent to them first for them to then forward on to a health assessment team who then arrange an assessment with me.. to complete a report which is then sent to DWP. The delay was basically UC not doing their part.

    Now it's gone to the appropriate departments and my assessment has taken place my report is now with DWP and just waiting on the outcome. What the advisor couldn't tell me is the date the claim was made which has got me thinking are they going to backdate it at all.

    UC refer you for the assessment. Once this is done you’ll receive a letter on your journal telling you that you’ve been referred. You will then receive the UC50 form in the post a few days later.

    Once the assessment is completed a report will be written and returned to DWP. A decision maker will then take a look at that as well as any additional evidence you sent and make their decision. Once that decision is made you’ll receive the letter on your journal.

    To be clear UC is part of DWP.

    Hi @poppy123456 thanks for the feedback however this is not what has happened. They have never posted any letters on my journal for any referral. I've already had my assessment and they arranged that via phone. When I say they I mean the health assessment team. They called me to arrange this.

    I have had the assessment and await a response which I understand will be a letter on my journal. Which if fine what I wasn't sure of due to the delays which were out my hands is would the claim be backdated. Which as I have had sicknotes the whole time I believe would be now.
