    If the report has been returned they would be able to see it. If it wasn’t returned they wouldn’t be able to send a copy out to you.

    Having said that, I wouldn’t worry too much about what they told you because If there’s any points recommended they are not added up in the report anyway. They wouldn’t just be able to have a quick glance and tell you if there’s points recommended.

    The report is just a recommendation, not the decision. Once a decision is made you will be contacted and that can be up to about 12 weeks.

    Sorry you're feeling so worried @karen19862, I hope what Poppy has advised has helped put your mind at ease a little. The waiting can be really difficult so please take care of yourself as much as you can.     Thank you xx washed out had 3 hrs sleep since Friday and my nerves are on edge.

    It just seems the same as last time but I'm sure as soon as I know the outcome , I will feel a bit better. If I have to appeal it will give me focus x

    Well I received my report today recommended absolutely nothing on every page it's copied and pasted that because I smoke I don't have any limitation in my hands 🙃 also she asked if I drove and I said no! Which I don't. And it's claimed I drive coz I do have a licence which I got when I was 25.

    I'm sorry to hear this. That's not the decision letter though, it's just a recommendation. They do mostly go with the report but it has been known for them to go against it.

    Have you ever got some expert advice to check that you definitely could score enough of points needed for an award? It's difficult to advise whether you would qualify because I don't know how your conditions affect you.

    Unfortunately, there are some people that just don't qualify because if you don't meet the descriptors you won't score the points needed for an award.

    I would definitely advise you to think about some expert advice before proceeding any further with this. This link will help you find an advice agency that's local to you.

    There is no indication that my claim has been actually read it just repeats the same thing on every single page.

    Hi me again!

    I have had my descision and again with 0 points . I have combed through both reports and it has been decided that they cannot award me because I smoke a cigarette and have a driving licence is the grounds for refusal.

    This is copied and pasted on every single page of the report along with the paragraph that I had good cognitive behaviour throughout the assessment.

    They have mentioned my report from April 2023 and compared that but nothing from the tribunal hearing.i was 2 points off in the hearing.

    I absolutely believe that the assessor has not even read my claim form before writing this and there is very little written from the assessment telephone call either.

    I have fibromyalgia, osteoarthritis, asthma, spinal stenosis which I need surgery for, I've already had 1 op 7 years ago. I also suffer from severe bouts of Ibs.

    My claim was well researched and well presented but because some of it was handwritten as well as I smoke and hold a licence this is basically the grounds for refusal.

    I have made a complaint to maximus and have spent the last week on my MR.

    Physically and mentally exhausted but I'm prepared to go to court if need be as I know the chances of the MR being overturned are extremely rare.

    I'm pretty sure that the mobility part of pip allows people to obtain a mobility vehicle so find this very strange as 1 of the reasons for refusal. I am not claiming for mental health reasons its mainly physical and the fact that the stress is due to ibs and the incontinence.

    Sorry for the long winded post but I'm shocked to say the least.

    Thank you, I just don't understand the reasoning the comments have nothing to do with any activity or descriptor so my Mr will be asking them to justify this.

    Exactly. I have spasms in my upper body which relay down to my hands at times I have numb ring fingers and little fingers on both hands this stems from my neck. My first , fingers are OK on each hand so I'm unsure what smoking a cigarette has to do with anything. I don't smoke with anything above the elbows honestly this and the fact I have a licence is the conclusion on every page by 1

    Seen my gp today! Prescribed tramadol ! With it being at the MR stage should I tell them ? She's shocked at the state I'm in x

    Hi @karen19862, I'm so sorry to hear they scored you 0 points, I can totally understand your frustrations after that result! Fingers crossed the tramadol helps you feel more comfortable.

    You could mention that you were recently prescribed it for the severity of your pain, but I'm afraid I'm not sure whether they'd be able to take that into account at this stage. Perhaps one of our other members might have a similar experience and can share what happened for them.

    It's horrible to have to fight for what you need, but I hope you have more success with your appeal. Keep us updated!

    It also states on my report that I'm on the lowest dose of duloxatine 2 x 60mg when I saw gp she said there isn't a higher dose I'm on the maximum.

    Think it's just any excuse not to award

    Right I've trawled through all the forums and the Internet and no where does it say that pip can be refused because u have a driving licence or because I smoke a ciggy a day.

    I am so confused right now

    It's on every descriptor page too and the decision maker has put that too.

    I've challenged this as a flawed report but I doubt they will do anything as per

    I've told them to check with dvla if that's what it takes .

    Yes copied and pasted on every page except the moving around bit.

    I've put a complaint in and the MR but I doubt they will even look at it fully

    Dear Karen,

    Why don't try to ring the Scope help line? The staff is very helpful and knowledgable! Maybe read out to them your form, to se if you have a good aproach to all the points? Just get yourself ready for the Tribunal. With good supporting letters if you could manage. Maybe look up for a local disabled charity? Maybe they could accompany you to the tribunal?

    In one of my assessments, I got 0 and the assessor clearly states she has NO my form, or medical evidence available, I think this should be criminal!! I use to get a PTSD just from reading the forms lies and made up stuff. Then after months of anxiety, I would beawarded it back at the Tribunal.
