You can read about the WCA process here:

    https://www.gov.uk/government/publications/universal-credit-if-you-have-a-disability-or-health-condition-quick-guide/universal-credit-if-you-have-a-disability-or-health-condition

    In a nutshell:

Report a health condition & submit Fit Note

Be referred on day 28 to the Health Assessment Provider.

Be sent a UC50 form which you fill in and return.

Have an assessment- most people have them via phone or face to face.

Receive one of three outcomes: LCW (no extra money), LCWRA (extra money but please see my note below), fit for work.

It takes as long as it takes- some people don't wait very long, others wait ages.

It's important to note that per couple the maximum entitlement is one LCWRA element & one carers element on a UC claim.

As per your other posts, if one is awarded LCWRA, several things will happen:

    LCWRA is added

    1x Carers Element is removed

Any Transitional Protection reduces by the LCWRA amount.

There is a current court case about the fairness of this, but the outcome is not yet known.

That’s incorrect . Each cater can get the element .

Under UC, the same person cannot get LCWRA & Carers element.

Therefore the entitlement would change from 2x Carers Element to 1x Carers Element & 1 LCWRA.

Yes both of you can receive carers element. If one of you have reported your health condition and providing fit notes if found to have LCWRA then kimmy's advice is spot on. It would mean that you will lose one of the carers element as well as any Transitional Protection will erode by the same amount as the LCWRA element so a double whammy.

The only good thing for you then would be that you will be entitled to the work allowance, which means £673/month (because you're not claiming for help with any rent) of earnings you receive will be ignored before any deductions apply. At the moment because you don't have children on your claim all of the earnings you receive will reduce your UC by 55% because you don't currently have the work allowance.

I’m not claiming lwcr - I haven’t put medical certificates in . I merely said I don’t understand what this is . So my comment is correct since I’m not claiming it

Yes, we know you're not currently claiming it. We are just advising you what will happen if you did report your health condition and are found to have LCWRA.

My reply was based not just on my thinking you might apply for LCWRA, but to warn of a big pitfall if you do.

I have no idea about UC I know that tax credits was more beneficial to us . If I got 875 a month plus our carers allowance - how can I possibly be better of on uc if they deduct CA from the couple allowance . I did get severe disability on tax credits but Uc don’t do that .

Transitional Protection will make up the difference so you won't be worse off when you migrate. What needs to be done first though it to sort out the problem you have with your journal and lack of information it has on it, your statement and payment.

I will add that it would be much less confusing if you could stick to your other thread, rather than continue commenting on this one.

what do you want me to say . Suddenly I’m bombarded with info on lwcr or whatever it is for saying I don’t understand it . Not that Im claiming it or want to claim it . I’ll just keep my mouth closed .

There really is no need to be so rude. Kimmy and myself have spent a lot of our time this evening trying to help you. We both have health conditions ourselves and the time we spend here advising thousands of people is done freely in our own spare time.

We haven't been rude to you, we just tried our best to help you.

you both assumed wrongly that I was claiming LWCR or whatever it is and gave me a lecture on it . Thanks for the info but as I said I don’t understand any of it. I appreciate your time and thanks .

We didn't assume anything. We gave you advice because you asked what it was. Neither of use knew whether or not you had reported your health condition, which is why we said IF.
