    You only get the extra for January.

    It means in your January payment you will get the LCWRA element of £416.19.

    but if August/sept/nov is assessment period why don’t I get for Dec ? How do I appeal the decision on backpay as I backdated that sick note do I click payment and written I would like it to be looked at again please ?

    or was I meant to receive December element ? Because it wasn’t in my December pay but in the letter the assessment period stated August through November

    either that’s bad English or it says I should of gotten the December element so in Jan will I get December and Jan element in the same pay if things was worded properly and clearly i wouldn’t need to come to a forum :/

    uc payments are a month behind are they not so the 28november to 27 december is paid in january as you have been advised by my reckoning

    Each UC payment is based on your circumstances for the previous calendar month, known as the Assessment Period.

    For your November/December AP, you became eligible for the LCWRA element as the waiting period for that to be payable is now past.

    Your January payment is for the November/December Assessment Period and will include the LCWRA element of £416.19.

    UC have applied the waiting period from August due to a gap in you providing the Fit Notes. Unfortunately it is when you provide them rather than the dates on them that counts.

    The waiting period is three full assessment periods. No money is paid or subsequently owed for that period.

    So your timeline is:

    August/September AP 1

    September/October AP 2

    October/November AP3

    November/December Eligible for LCWRA element.

    January: First payment for LCWRA element made.

    If you would like to ask them to reconsider the decision on when they have started the waiting period, you can add a note on your Journal asking for a Mandatory Reconsideration.

    I’ve just read the whole thread and if you look back at kimmys advice you will see that she’s advised you what the waiting period is based on the information you have given.

    To recap your waiting period is as follows… Dec/Jan, Jan/Feb, Feb/March.. LCWRA element starts from assessment period 28th March to 27th April and first payment will be 4th May 2023.

    This is assuming there were no gaps at all in your fit notes right up until a decision was made. Gaps can affect when the extra money is paid from.

    The reason it probably wasn’t included in your last statement was because there wasn’t enough of time to include it after the decision was made.

    Money owed will be paid as a separate payment and very often can take several weeks to pay it.

    As the decision was made 4 weeks ago I’d advise you to put a message into your journal under the payment section and ask about the money that’s owed to you.

    You will need to check your next statement to see if this months element is included when you receive it.

    @Kimmy87 i didn’t read it as there was a gap. Fit notes were given monthly up until August 2023 and then 3 monthly.

    Although I can see why it seems like there was a gap due to the way it’s worded. James said the following..

    my first was December 2023 when I just checked and they was consistent given in monthly. August/sept/october 2024 I was given a 3 month fit note, November was a 1 and a half month fit note due to run out last week

    no I won’t ask them to do that I do understand but to me I just don’t read it as 3 months to me that’s 4 months if the assessment period is August through November. And awarded for December then why would my payment be in January shouldn’t my December payment have the element and my Jan payment have the element to me all I see is that December payment isn’t given. I just do see it. If I’m eligible in December why did I not receive it ? If I only get it in January ? To me it reads as I’m eligible in dec but only getting it in Jan when if eligible in December then why didn’t I get in that payment then again in January I’m not good at typing but do you get what I mean ?

    You are eligible for December, but the payment comes through (for December) in January due to how your dates work.

    Your eligible Assessment period is November 27th to December 28. The payment is sent 6 days after that so 3rd January.

    @poppy123456 OP confirmed on December 12 that there was after all a gap in providing Fit Notes which is why my advice changed.

    3 full months I understand… but from 28th August then sept then oct then Nov that’s 3 months December would make it 4 months so I cannot for the life of me understand why I wouldn’t get the element in Decembers payment.

    Your payment received December 3rd was for the October/November Assessment Period. This fell within your LCWRA waiting period.

    Your upcoming payment on January 3rd is for the November/December Assessment Period, when you are eligible for the LCWRA element.

    @Kimmy87 ah thank you, not sure how I could have missed that. Using my phone for the few comments I’ve made since this afternoon and it’s not as easy on this as it is with my MacBook.

    The reason for this is because UC is paid 1 month in arrears. Your payment on the 4th January is for the period 28th Nov to 27th Dec. This is why LCWRA is paid FROM the 4th assessment period, with first payment being the end of that month.
