    I started UC on 19/02/22

    DWP requested an assessment to work 02/22

    Ps forgot to say broke knee cap and ruptured ACl 19/12/21

    Got a telephone call in July 2024

    Full LCWRA award in September 2024

    Payments increased and back dated to may 24 to December 24 8 months in total


    I understand first 3 months no payment

    Fit bits on journal all up to date


    huge delay and condition is worse plus had a major operation in November 24

    Do I get back date for all months or part ??

    Ok thank you for the clarity there and congratulations on the LCWRA award!
    If they have said back pay is owed, they will have stated how much and for which months, so it's best to check the letter to see what's said there.

    As there's only one rate for LCWRA, a worsening in condition would not lead to any further money owed.

    That's an awful long time to be waiting for an assessment. Was this your very first assessment or you did have one prior to this?

    If this was your first one and there were no gaps in your fit notes right up until a decision was made then it will be from either June or July 2022.

    If there was anytime where a fit note was backdated then that counts as a gap because usually they will not accept backdated fit notes when working out when the extra money is paid from. You can check through your journal to see if there were any gaps or backdated fit notes.

    leg is stil not operated on pending

    On journal DWP request a medical examination 22 February 2022

    We wait til 19 th July 2024 get telephone call for assement not video call took 1 hr 33 mins

    19 the September monies go up

    Lost my phone during major surgery on 27 th November 2024

    Had to attend job centre 5 days after operation with 63 stitches and had to get a lift no vehicle

    At 9.30 am 23 rd December 24

    Then at 12.33 same day my LCWRA payments are back dated my payment schedule on journal ament back to DWP


    I’ve only had 1 assessments

    I award 8 months back dated

    But 20 months not addressed


    condition hasn’t improved , operated on , worsened in period of 21 st January 2022 to award date 19 th September


    no timelines or referrals on award letter

    I need to understand my rights I think it’s way to long and it’s been hard on my mental h although after 30 months to get award but no clear dates of award period ( just stated during this assessment period )so I’ve only had 1 in 30 timeline of recorded events , requests and up dates from DWP on the portal called Jornal also a super quick response in just 3 hrs from an agent at DWP same day as I request up date on LCWRA it gets back dated to may 2024 stating from DWP in line with period of medical time lined assessment period on LCWRA report which I don’t have or medical to me it human error is my thoughts as it was rushed in busy Christmas period

    On calendar months timelines from activation . Reports . Requests for medical report . Response and award it seems correct on timelines in 1 month DWP request medical report and 3 month waiting period in LCWRA statutory review period and non payment but they simply missed dates of years 2022? January/ September 2024 in there calculations of back date

    Awarded and monthly goes up ✅

    I can access my journal as I lost phone I had to be ID in person in job centre after calling call centre I notify them my current medical condition and 63 stitches but made appear

    The same day I read the jornal comment and ask if this is to be settled and thank for the last 3 months payments adjustment to include LCWRA

    3 hrs later they back date it yo may 24 in line with LCWRA letter


    this is now where I’m lost I don’t see and time lines period of assessment

    DWP is referring to this letter but I send a request to mandatory request to explain on 23 rd December 24

    Which is my current position as I’ve had no response


    hence me reaching out for help and support

    My conclusion is this


    start claim Allow timelines for waiting guilines

    It’s May 2024 back to may 2022 surely

    Not 8 months back date of a 3 rd year waiting for 1 st award of LCWRA

    What date exactly did you provide your first fit note?

    What date do you usually receive your money each month?

    Work coach meeting and access to journal and UC confirmations are recorded in comments


    I have reviewed my fit notes I have requests for up date fit notes

    No sanctions in relation to non compliance of issuing fit notes


    I’ve got 4 back dated and DWP issue letters I respond on medical conditions and history and current medical conditions delays

    Every time DWP update journal and now sanctions or deductions


    no letters saying it delays or effects LCWRA payments


    in fact no mention of this type of credit awards on receipt of a medical report it only appears in October


    may I send the letter of the award and DWP payment response so it’s more explainable

    Or help I can contact

    I wouldn't expect them to sanction you for not providing fit notes. A sanction means they reduce your UC payments and this wouldn't happen in this case.

    In an earlier comment I advised that backdated fit notes aren't usually accepted when it comes to working out when the extra money is paid from. You then told me there were no gaps but now you're saying fit notes were backdated, which means there were gaps.

    I can only give advice based on the information you give. If you miss out information then there's a high possibility that the advice I give is incorrect.

    You can post details of the payment response but you need to make sure all of your personal details such as name, NI number, address are all covered up or removed.

    Gaps in providing Fit Notes effect when the waiting period starts for LCWRA element to be paid.

    Even if you subsequently provided a backdated Fit Note, this won't override the above.

    hi again


    I’ve spent most of Christmas and doing my homework on my Claim

    And let me say to all thank you your comments have given me new strength to fight for my rights and correct benefits entitled


    so recap I’ve spoke to law depot portal explain I item gaps or back dated fit notes .

    On my jornal you scroll through and there isn’t a single message on fit notes up dates from me only messages from UC updating my commitments

    When your fit not is due UC request you to open jornal and complete and to do’s or commitments and you fill in your self declaration of current fit notes start and end dates once you complete and you get a agents updated message the only record is a message stating you have complete fit not up date no record of dates

    So apart from reading through my jornal and seeing I complete any updates while UC conduct s medical assessment to deem me fit or unable to work due to my medical condition

    There’s no way I can check if there’s a gap or backdated on jornal or am I wrong please advise

    So I’m payments I don’t never get paid if fit notes are not provided it causing payment delays and termination in claim ???? Not the case

    But here’s where I’m truest confident of a full award according to law depot portal advice notes

    If the LCWRA is granted and maximum amount is granted to a claim it is deemed that the claimant is not fit to work

    Didn’t attend work coach meetings , don’t have to issue fit notes until able to go back work

    So if at award stage of full LCWRA award and maximum of increase in benefits this clearly defines from start of claim the claimant wasn’t able to work and is until further medical care will not return to work so claim is full award and claimant has no obligation to provide fit notes as awarded full LCWRA benefit

    Hospital operation delays also determine claimant eligibility as no change in circumstances which again is a vital section of DWP portal sections and is part of claimant’s commitment

    So sorry to detail in long brief but I wanted to explain my position

    UC starts 21/01/22

    Medical 07/24

    LCWRA 09/24

    Only question any back date on 16/12/24 and within 3 hours same day it’s back dated to may 24

    Surely it should be may 22 the 3 moths legal period and payment kicks in on 4 th month
