When the DLA changed to PIP, my claim stopped. After many years it restarted. Will I be able to be backdated all the years that I missed out on.

    More information is needed to advise, but long backdates are very unlikely.

    Why did your claim stop when changing from DLA to PIP? Did you appeal this at all?

    What were the circumstances of PIP being re started?

    If you were refused PIP at that time and you didn't challenge the decision and went onto be awarded sometime in the future after you started a new claim then no, it will not be backdated.

    I did challenge it. I didn't make a new claim, they just restarted it.

    Was this MR stage or Tribunal? Which ever one it was the decision letter will tell you when it’s paid from.

    I think you need to give more details because we can’t advise on such little information.

    You were claiming DLA and then claim PIP but were refused, is that correct? If so when was that please?

    How long after that did you challenge it? And when did it restart? And when was it paid from?

    Are you still claiming PIP?

    I claimed for pip once it changed from dla and was denied. I appealed it and got denied again. After 12 years they decided to change their mind without me asking. I'm only asking on what to do to claim the 12 years I missed out on.

    Why did they change their mind? Was it recently restarted if so have you had the decision letter? It should tell you on there when it’s awarded from?

    Sorry for all the questions but this all seems rather odd.

    This is all very interesting.I so wish I'd appealed my pip Decision all those years ago and then perhaps I might be in your position rather than were I am now.

    I had no information about it. I just started receiving it. It restarted about 2 years ago without information what so ever.

    Very strange and you didn't receive a decision letter or any letter at all with any explanation?

    Are you sure you didn't start another claim or maybe you have an appointee for another benefit and they started the claim for you?

    If not then, you need to get some expert advice from an agency near you because this is beyond any help we can give here.

    You could try requesting any information they have about your PIP

    There might be a clue as to why it re started and any grounds you may have to request backdated payments.

    Surely if a claimant got a whopping backpayment such as that, it would tip them well north of the £16,000 cap? Be careful what you wish for!

    Please excuse the above comment. In my rush to attempt humour, i forgot that PIP isn't a means tested benefit.

    Even if it was means tested, money that is owed for benefits payments are disregarded for 1 year.

    Although PIP isn't means tested if someone is claiming a means tested benefit, any money that isn't spent at the end of the period it's paid for is treated as capital (savings) for means tested benefits.
