Re determination

Hi cam anyone help, my citizens advice helper asked for a re determination about my award and now they have took everything off me, he never advised me this could happen what do I do now. If anyone has appealed from re determination have they won. I am so upset as didn't know they could do this. Thank you.

Hi @gg55, when you say a redetermination do you mean a Mandatory Reconsideration? I'm sorry if they gave an even harsher decision at the MR stage, it is rare but can happen. There is still the tribunal appeal stage however, this is where it goes before a tribunal and they will consider the evidence from yourself and the DWP before making a decision.

Hi yeah think it's the same thing, so originally was granted standard daily living was advise to do this and now got nothing.

I have recently given advice about how to challenge a review descision and this advice should also apply to a change of circumstance descision also if the award has been reduced or removed as has happened in your case. My adivice would to do a written Mandatory Reconsideration and include as much detail as you can. Do not telephone to start your MR. You have one month to do your MR Letter and then another 12 months if you provide a good reason for a Late MR request. You reason could be ill health because of your disability or condition or it could be that you were seeking further information and advice.
