Transitional protection payment & lcwra
Just to clarify if someone does managed migration to UC & first payment includes transitional protection payments with carers element & no LCWRA: what happens to the transitional protection payments if they go on to claim lcwra? Do they completely disappear & lose all transitionals? Or are the transitional payments simply reduced by the amount in lcwra they receive? I know they’d lose the carers element.

TP erodes over time. So if other elements increase or you become entitled to other elements then the TP will reduce until such a time it will erode completely. Whether the LCWRA element erodes it completely will depend on how much your TP is.

So just to 100% clarify if its single claim:
then a LCWRA claim will not make them any better off as opposed to carers element + TP? As TP will be just be reduced by the difference?0 -
I have no idea if they will be better off because i don't know what the TP amount is. Yes, the TP will erode.Don't forget also, if they're already claimed UC with the TP then when benefits increase this year they will not benefit from that increase because the TP will just erode.0

You're claiming ESA and in the Support Group. LCWRA refers to UC and not ESA. As I explained in a previous thread to you this evening, TP erodes if other elements increase or you become entitled to other elements.
For example, if benefits increase next April and you've already migrated to UC and they increase by say £25/month in total then you will be no better off. This is because although your UC statement will show other elements have increased, that increase will be taken from your TP element, so it decreases by the same amount. Therefore you would be receiving the same amount of money as you were before the increase.
How quickly it erodes to zero will depend on circumstances and no one can possibly tell you how quickly this will happen because everyone will be different.
Your PIP of course will continue as normal and isn't part of UC.

I was wondering if someone could also advise me. Myself and my wife are due to migrate to uc. We have 4 children 3 of which receive DLA. My wife is our youngest daughters carer. I am in receipt of PIP enhanced on both elements and receive working tax credits which includes sdp. I work 15 hours a week due to my disabilities. I am aware that uc will expect me to work longer hours which i am unable to do. When i ask my gp for a 3 month certificate i am aware this will start the lcwra process. If awarded will this completely wipe our transitional protection at all?

Hi appreciate some help on just recently awarded lcwra my carers element has gone .but my TP has been deducted to 209 from 625 .which leaves me £200 a month less .surely this is not right ? Thanks

As I advised on your other thread, unfortunately as the rules currently apply this is correct. Hopefully the outcome of the court case is released soon and is a positive result.

Hi poppy I have just been told that ,lcwra is taken from your TP and your left with the rest ? So I thought they deduct the difference from your carers element and lcwra and deduct that from your TP .which one is right .thankyou

Ahhh ok .so unfair how they have worked this out .it's like my disability premium from when I was on income support as now been taking away as I am £200 less a month,even though it's acknowledged I have health problems .really hope they sort this process out fairly.thanks for your reply

Yes, I completely agree it's very unfair and not correct that they do this. I really hope the Upper Tribunal rule this unfair but how long it will take for a decision I really have no idea.
You are not alone with what's happened here and many others have been caught out by this.

No, that’s a completely different thing. There’s been no decision made on this from the Upper Tribunal.
