UC Work Capability Assessment

Hello,
I have my telephone assessment next week Saturday June 22 between 9am and noon, I was wondering if this is normal to have this on a weekend and at no specific time, the letter says be available between 9 and noon, also is this anything like PIP where you are paid from the time of first claim? And are you paid once a decision is made? How long are you paid for, is it until you are fit for work? Thank you

Yes, it's perfectly normal for it to be between certain times. This is because they can't guarantee that they will ring you on time. It's the same as when you attend in person, there's no guarantee that you will go in on time.
They do assessments on Saturdays and bank holidays. Once a decision is made if found to have LCWRA and it's Universal Credit you're claiming then there's a waiting period of 3 full assessment periods starting from when you provided your first fit note. It's then paid from the 4th month of your claim, with first payment being the end of that month. The extra money isn't paid at all during the waiting period. This is assuming you don't already have LCW from a previous assessment.
If found to have LCW there's no extra money each month.

Thanks Poppy, ok my first fit note was provided in February so this is the 4th month and Iโm guessing you mean there isnโt any back payments.

If found to have LCWRA when the extra money is paid from exactly will depend on what date exactly you provided your first fit note and what date you usually receive your money each month. It's 3 full assessment periods, part assessment periods do not count.
The extra money isn't paid at all during the waiting period. If it takes longer for them to make a decision then you maybe owed some money.

I just received my decision on my journal and it says I have limited capability for work
I have requested for the full assessment report
I have an appointment at the job centre for new commitment review
Just thought Iโd put an update here
Donโt know what happens now
Thanks

If it's just Limited Capability for work. (LCW) then you will not receive any extra money for this. You may also be expected to attend work focused interviews at your local job centre to prepare to work in the future.
If you're not happy with the decision and think you should have been found to have LCWRA then you can request the Mandatory Reconsideration. Before doing this I'd advise you to take a look at the descriptors to see if any of them may apply to you. You can see them here.

Hi Poppy,
Looking at the descriptors I do fall into some categories so would probably request the mandatory reconsideration, also will wait for the assessment report then will decide definitely on what to do anyways thanks very much ๐

Good luck with the MR! Let us know how it goes ๐

Thank you, I have just requested for the MR and I did it through my journal and told them why I disagree with the decision so fingers crossed.

I have been told today on my journal that I have a work focused interview tomorrow over the phone, is this the normal procedure while waiting for your MR decision?
0 -
Yes that's normal when you have LCW because it means you're expected to do work related activity, which means appointments, either by phone or in person at your local Job centre.

MR decision just came back through my journal as no change. They believe the LCW decision is correct, so I have been online to appeal it, I just want to see this through to the end really and know that I did my best lol

I attended a face to face tribunal hearing today, a judge and a doctor was present, still awaiting a decision

If you were able to track the appeal online you should be able to log in and see what the decision was a few hours after the hearing took place. They will of course send you a decision letter within a few days.

Hi Poppy, I donโt have an online account to track so will wait for letter, not very confident though, whatever happens atleast I tried haha thank you

So I called the tribunal this morning to see if I could track the decision as Iโm still yet to receive a letter and the very nice lady on the phone said she would email me my decision instead which she did within 2 mins, appeal is refused well was never too confident on this but pursued it still, not too disappointed atleast I tried lol

Sorry it was a disappointing result for you @toysoe1, but it was at least worth trying. I hope they can be understanding of your conditions and everything works out okay.
