Seems like they then accepted your new fit notes from Feb 2022, so potentially from then. It will be down to a decision maker to decide whether it’s from May 2021 or Feb 2022. I think the full 3 month assessment period also applies after that and the the extra money is paid from the 4th month after the fit note was reported.
Completely agree with the above posted by poppy. In the circumstances I would definitely aim to get backdating of LCWRA to May 2021 which is when you reported the change even though DWP then wanted more information to support your statement that a change had occurred.

As poppy also says, because you were previously treated as fit for work the waiting period for the LCWRA will apply from that start date. That means that if LCWRA is backdated to May the extra money would be payable from September or October 2021 depending on the dates of your UC assessment period and the exact date you reported the change.

I didn’t understand what you meant to type in your opening post when you said your “wife decided to So”. Are you still living together or are you now living alone?

I have been Awarded on my journal today backpay until last December. I have put in a challenge to that award but I will receive 2k on Monday. So They were only 500 quid off of my bottom level before i accepted it. But you can tell they know they have done wrong because of the speed things have happened after My customer service and ICE complaint. One customer service got involved my appointment happened in under two weeks and only two days later I was told i had won. Also the back payment will hit my account on Monday. Thank you so much for all your help you guys are Amazing.

I have been Awarded lcwra but i didn't get the back payment till may 2021. I only got it till June of  this year. I have asked for a second consideration. If this fails how do I take it to tribunal? The issue they have used is that I didn't get the additional info they needed until December 2022. This was due to lockdown and even though I kept asking for a doctors appointment I couldn't get on due to covid and the NHS overload. However UC did keep accepting my fit notes. I eventually got my appointment with a doctor on the phone and they decided that was when i provided fresh evidence. I couldn't get it before no matter how hard I tried again due to covid lockdown

I don't understand what you mean by the highlighted part above. LCWRA has no end date and it doesn't just stop. It's an ongoing award until a new decision says otherwise.

All reviews are currently suspended and when they do start there will be huge backlogs so it's very unlikely that you will have another review anytime soon.

In your case there's nothing to challenge.

HI @Poppy123456. I'm not trying to challenge my award. I am challenging my back payment. they have paid me from june 22 however I first asked for a LCWRA assessment in may 21 with a string of fit notes so my back payment should be four months from than so I should be back dated until August or September time. I am missing 11 months of back payments this is my challenge. If I get turned down on my referral for a second look at this back dated period, that's what I want to challenge at tribunal

Ah ok, thanks for theat extra information. If it's from May 2021 then the extra money will be from either Sept or Oct 2021 depending on exact when you reported the worsening of condition in May 2021 and what date you usually receive your money each month.

That's how I see it however they don't. due to the time it took to get a doctor to re assess me. Hence only backdating me till June 2022 not may 21

They very often get this wrong. It's so frustrating that after all this time they still don't understand their own rules. Poorly trained staff!

That's all I can do. I don't expect to win the mandatory consideration but i do expect to win the tribunal. My issue is I don't know hoe to take things to tribunal.

There's been several threads here where UC haven't got the start date correct and requested the MR and gone on to have a decision in their favour.

With a Tribunal you should cross that bridge if needed. Concentrate on this first. Once you request the MR it can take up to 12 weeks for a decision.
