Hello I had my appeal by video yesterday Monday the 13th of Feb 2023 for limited capability for work and work related activities and won, I asked them to send my letter by email so got that yesterday and it says the decision made by the secretary of state on the 26/03/2022 is set aside I'm not to sure what that means, will I get money back dated till that date and it says I am to be treated as having limited capability for work related activities so I have got that right hadn't I, thank you for any help and how long will it take for me to get any back dated money

It means that the decision made by DWP last year no longer applies because you have been found to have LCWRA.You will now be owed money from the 4th month after you originally reported your health condition. Providing you sent a fit note with 7 days of that and continued to send them without any gaps until the original decision was made.It can take several weeks to pay what is owed.0

Dos 4 months after my original date still apply to me because it wasn't a fresh claim I had all ready been awarded lcwra back in 2018 this was just a re assessment and they said I had lcw so I appealed it, I didn't need to send sicknotes in0

Then the waiting period doesn’t apply.0

I've got another question so I had a joint claim with my then partner when I just lost the lcwra but he kept it, like i said I appealed it and won mine back yesterday but during waiting for my case to be heard I unjoined and went to a single claim that was back in August to September assessment 2022 but I first appealed on the 26/03/22 so my question is will I just get the back date from when I went to a single claim or will it go from when I was joint claim but like I said my partner at the time had lcwra so that's the confusing part because I know you just get the one payment even if both are found to have lcwra0

When claiming UC with a partner, only 1 person can receive the LCWRA element per claim. This means that you won't be entitled to the extra money from when you were claiming with your partner. You will only be entitled to it from when you were a single claimant.
