Hi guys and girls ,

DWP will try their hardest to short change the ill, disabled and sick.

Here is my story, I was duped by their incompetent system. They offered me nothing. I contested their decision.

They rejected the mandatory reconsider notice. I applied immediately to have a tribunal. 

I was informed the tribunal could take many months, no problem I had zero to lose. Fast forward, after just four weeks of requesting a tribunal someone from DWP called to inform I would be granted PIP.

The reason why I am posting this message is to share my own personal experience and would encourage everyone never to give up.

    Congratulations on your award and I am pleased you did not give up. You are correct that people must continue to the end.
    The main reason why people are reffused PIP is because they do not understand the activities and what the descriptors mean.
    If anyone is going to make a claim for PIP it is strongly advised that they seek advice or do research before they make there claim. Also fill in the PIP2 form questionnaire in detail with real world examples of what happened when you last tried that activity and if anyone witnessed it and what the outcome was.
    Also PIP is a "system" so if you do not get an award at the first stage after your assessment then there are 2 other stages you can use. A Mandatory Reconsideration is good if you did not give a detailed PIP2 Questionnaire form you have a second chance at giving a very detailed MR letter which can then be used in Stage 3 your tribunal as supporting evidence for the appeal panel.
    When you submit for tribunal the DWP take another look at your claim (Hence it is always a good idea to give a very detailed MR Letter) and if they can make an award before it goes to tribunal they will contact you with an offer.

    I don't understand how that means the DWP have duped you. If you given you an award. If you are satisfied with the award you now have you can make a appeal direct to the tribunal service.

    Perhaps the way that I worded things in my post was not worded correctly.
    DWP would have duped me if I settled for their first and second decision. However I contested what they thought based on what I knew . 

    Hope this clarifies things for you. 

    My post was about trying to help the best that I can for others.

    It I wouldn’t describe it as ‘being duped’. The reason there is an appeals process is prescribely so that claimants can contest the first decision. 
     
    You are of course right to highlight that, when appropriate, to exercise their right to challenge the outcome.

    This sounds similar to what may have happened to me. I say may because I did not answer the phone - PIP rang me a couple of days ago but I did not answer as it was an unknown number to me, they texted shortly after but did not ring again, this was less than three weeks after I submitted (online) an appeal. My online appeal informs me I will get a letter in the post which has not arrived yet. I'm hoping I'll get an award like you or an offer but I suppose it could just as easily be no change and appeal process continues, if that happens then why did they try to ring me at all? They have had more than enough paperwork from me and they have even contacted my GP, I have nothing else to tell them.

    I agree with using the work 'duped'.

    It makes sense to me that you would feel that way. This is because the only DWP changed their minds after you'd decided to ask for a judge to look at it.

    Had you not asked for a judge to look at it, the DWP would have left things as they were. And without anything new or different going on how could the DWP suddenly have had such a change of heart? Did they have a change of heart because now someone else was going to look at it?

    In this way I agree that you feel duped. 

    The only way it may to the DWP's 'benefit of the doubt' is if if you put new, different information or worded things a different way when you put it in to the tribunal that the DWP know about at the time. And once they reviewed it could now see differently, this would be fair enough and not duping anyone.

    It's right to feel aggrieved Paul and there are things you can do such as writing to your MP or charities as well signing petitions.

    You're not supposed to be a knowledgeable expert when it comes to dealing with the DWP and the systems yet very often it seems the only way to manage is to become one.
