denying lcwra

I am really not sure anyone can help me here, but I just thought I would try.
I was awarded lcwra after an assessment, this was in February. I contacted uc regarding my backpay from the first date of my sicknotes, but they are denying it me. They are also questioning my award, I do not really want to go into details, but I have been awarded it by their own accessor . How can uc deny it when they have absolutely no idea on my situation. Sorry about the vague description . but I am desperate to contact the correct person, NOT a case worker or decision maker

The assessors do not make decisions, nor do they give awards, they make recommendations only. The decision isn't final until a decision maker makes that decision. Whilst they mostly go with the report, it has been know for them to go against it.Are you going by the recommendations in the assessment report? Has a decision actually been made yet? If so what was the decision? If a decision has been made by a decision maker and you were found to have LCWRA are you claiming UC with a partner that already receives the LCWRA element on your claim? You can only receive one LCWRA element per claim.0

Hi @flobbylob and welcome to our online community, I'm glad you found us and I hope we can help provide some answers. If you could reply to Poppy's questions that would be fab.
Just to advise, I've moved your thread to our Universal Credit (UC) category to help others find it more easily.
Take care and have a fab weekend.0 -
Hello @poppy123456
Sorry for the slow reply.
I am so sorry my earlier message was a little confusing. I know about everything you have written and advised about on the above message. Thankfully it has all been sorted, but I am now confused regarding lcwra payment. When I first read about lcwra there was an element of it that you received extra payment if you did not have your rent payed for you by uc. I unfortunately cannot find that anywhere now .I hope you can help ? Thank you0 -
There’s no other element of LCWRA.The only thing I can think of that you maybe thinking of is the work allowance. If you and/or a partner if you’re claiming with one are working and receiving earnings then there’s an earnings disregard before any deductions apply. If you don’t claim for help with the rent then it will be £631/month. If you do then it’s £379/month.
If you’re not receiving any earnings then it’s not going to make any difference anyway because it won’t apply. https://www.gov.uk/government/publications/universal-credit-work-allowances/universal-credit-work-allowances0 -
Hello Poppy
I am very sorry I tagged you,I just thought it was normal procedure.i do apologise.
So after I had replied to my post,I found what I was meaning.Anf you were right it was the work allowance I had seen. But Thank you for the information.
I now have another query. So I was awarded lcwra in February, and confirmed I would receive payment in may.so I messaged them a week or so after this date,to chase up my payment, only to find they were questioning my reward. So I sent a letter (I am not sure if this was a mandatory reconsideration at this point)and the decision was,I was still to be awarded it. But they are now trying to make me do another three months assessment period? Does this sound right?
Thank you

No problem. This doesn't sound right at all. The waiting period is 3 full assessment periods and the extra money is paid from the 4th month after you reported your health condition/sent your first fit note. When it's paid from exactly will depend on the answer to these questions. What date exactly did you report your health condition/send your first fit note? What date do you usually receive your money each month?0
-
I am unsure on the exact date, but I sent in my first sick note at the beginning of August 2022. I usually receive my uc on the 16th of each month.0

Your first payment should be either Dec or January. Without knowing the exact date it’s impossible to advise when it’s paid from exactly.Put a message on your journal under the payment section and tell them the exact date you sent your first note. You can check back on your journal to see what date it was. Tell them that the waiting period starts from when you first provided evidence of your health condition.0
